Unfortunately I have had lots of insurance experience this year. Four vehicles hit and one at fault accident.
I was not able to get diminished value for any wreck. I could not find dealer who would put reduced value in writing.
I had Geico. It was easier working through the other insurance.
The insurance companies will put you in comparable vehicle if you ask. If you do not ask , you will get economy car.
If I went through my insurance I got the deductible back after the claim was settled
In previous wreck, I had a new car dealer repair my car with duct tape. I found it several years later when the part was loose.
Ask friends for recommendation of good body shop in your area

That was my first thought and I called them because I figured they would be on my side. They told me however if they handled it I would be responsible for my deductible and told me to contact that at fault drivers insurance company,

Please tell us the name of this insurance company so we know who to avoid.

I picked that up too. Insurance companies usually speak to each other. Having a person in the mix complicates their internal dealings, or I would think.

Who is your insurance company. I want to make sure I never use them. That is what they are for. You may have to pay for your deductible up from but will be reimbursed by her insurance company when all is said and done. Just went through a claim last October where my 2012 Kia was totalled. My adjuster handled everything. The other party's insurance paid for everything including my deductible.

This^^^^^^. Your insurer should step up and handle it all. Get another company when this fiasco is done.

That is a job for a lawyer.. Ins co will not compensate for that. I never hard of anyone winning outside of a court order...and do not delay filing a lawsuit, if you want to win. The risk is that the lawsuit will be expensive..maybe you will win and still lose. So---Be sure that your lawyer will work on a contingency basis that has the necessary protection for your net gain, and not simply a percentage of the judgement awarded. Do the math with the lawyer before you retain him. Fighting an insurance company is very tough on the pocket, so most lawyers will avoid such cases.

The OP apparently has an agentless company, Geico, progressive, Esurrance, etc. they all operate in this manner. They process paperwork, but the claim is handled on their terms.

With just property damage, it is hard to justify a lawyer. They will be paid out of your damage claim.

Glad you weren't hurt. I wouldn't worry about getting a lawyer yet unless there is a problem.

They may ask you to sign a waiver saying you weren't hurt. Until you are happy with the repair and everything else getting paid, don't sign it. Thats one thing you can hold over their head, body shops are expensive but doctors and medical bill are huge in comparision.

I would insist that your insurance company handle the claim and all communications with her insurance. They are being paid well by you to do this. Pay the deductible if you have to and get it back in the end. I let my insurance handle everything. I don't speak to the other persons insurance except to give them contact information for my insurance. I agree that you should receive compensation for diminished value, but I have never heard of anyone getting it.

Exactly what my brother was told... and he is a smart guy... no legal experience.

After tiring of the Insurance Run Around... his wife's Volvo Wagon was T-Boned in an intersection by someone running a red light and being ticketed for running the light.

Three year old car was totaled and his 6 month pregnant wife was confined to bedrest.

The Lawyers all wanted at least a third plus costs and the other person's insurance was only willing to pay for the car... but, less than they had paid from Volvo the month before citing it had depreciated.

Anyway... my non legal brother decided to file his own suit because the Insurance Company would not speak with him...

He filed, had everyone served and requested a jury trial which he was in the middle of selection when the other side said they wanted to talk settlement... he simply asked if they had a check for the amount of the suit.

Anyway... he said he was enjoying the process and had 10 weeks of unused vacation time and was 100% confident of winning... and he did... the morning the trail was suppose to start with the jury being seated...

He was up all night studying case law and 100% driven to do everything right... and a 6 figure settlement made it worth his time.

I really think most of the time you have to fight and Insurance Companies know few will...

A little of topic... we had a multimillion dollar expansion at the hospital where I work... the contractor left a lot of the subs holding the bag... the big guys worked out deals and moved on.

There was a little family landscape contractor that was stiffed $4,500 and the contractors wife from Mexico made getting her money her reason for living... they did get some of it... but she also, single handedly had the contractors California License Revoked... something the big guys could not or wouldn't do.

I have a different one...I got hit by a bicycle. What sux is that they don't have to have insurance so I had to eat the deductible and the rental costs. The insurance company is suing the rider for my $500 deductible and their claim amount. Unless I small claims him, I'm out the rental costs since I don't carry that coverage.

The OP's insurance company should be handling this in a similar manner.
