I don't think there's any danger of the tree falling imminently, but it is in very poor taste. No different than taking a picture of the kid laying down behind the wheel of a parked car. Just poor taste. Some people find this sort of thing funny, but to me it's a bit sick.

This!

Agree, I don't find it funny!

About like dangling a child by the arm over a balcony for a couple of seconds. No danger at all to the child as long as you hang on tightly. Mr Jackson had a firm grip on his child when the dangling was done. He thought it was funny or cool or something, or he would not have done it. Millions of others thought him an idiot. Me included.

Maybe the tree was cut right above the picture.

I agree. The wood looks solid. The kids in more danger of getting hit by a falling limb once he climbs out of the protective notch.
Just last summer I was working around a big old oak. Beautiful ~ 4' tree. Good height and spread. No dead limbs - fairly calm air. I went off and came back. A big limb had fallen where I had been working. Plenty big to kill me if I took the big part in the wrong place.
,,,,,, Cant dwell on stuf like that or you would never be able to enjoy a tree.

Do the naysayers realize how much wood is still holding up that vertical tree? (Which assuming no wind and even branch distribution has very little horizontal forces on it.)
There's almost more 6"x6" posts in that trunk than hold up my pole barn (in the wind).
I'd bet you could hook a cable on that tree and you'd probably pull the roots out of the ground before the kid gets punched.
