I'm at a cross roads on this one. I can purchase a lightly used PA30 from a dealer that looks to be in excellent shape for just under 2k shipped. I could bite the bullet on a new one which my dealer is quoting. Or I can attempt to weld repair this one. It appears the seller isn't going to do the right thing so I'm debating weather I should try small claims court? Anyone have any other ideas I haven't considerer?

Edit, so dealer is quoting me $2400+ tax for a new unit.

Bummer.
Don't know for sure what would work on your CL seller, but I would be sure of one thing.. that is to write everything down in a letter to this seller with indicated copy to your attorney, the local DA's office, sheriff, and better business bureau. Make sure everything is accurate, with pictures, and with dates when everything happened.

If happened as you say, it would be pretty obvious to a "Judge Judy" in small claims court to who was getting screwed. IMO

The problem with small claims court is the verdict is unenforceable. Better the Judge Judy route.

It appears it's $100 for file the court paper work which isn't too bad. The only thing that concerns me is he took the add down so I don't have the proof he said it was in perfect running order. I do have all the emails and he verbally told me if I had any issues to let him know. Should I mention to him that'll I'm going to file in small claims and see if it persuades him to do the right thing? I really don't believe he knew of the issue but it's still his responsibility to accurately describe the item. Of course he's in another state so it's going to be a huge hassle for me to actually got to court. I also don't have any way to prove I didn't break it although I have no auger and the crack clearly isn't new.

Well finally some good news, the seller has agreed to take it back. I didn't even have to bring up the court stuff.
I'm glad he actually has a conscience as most in this situation wouldn't. So I guess I need to decide weather to order a new unit or jump on the lightly used one and have it shipped.

The used unit is $1450 plus shipping which I'm figuring is about $300. So $1750 vs $2400+ tax.
