If he doesn't have a survey, how does he really know where the property line is??????? He, the neighbor, and you, can all assume it, but until there's a survey, it's only an assumption. Best to get it legally recorded, then fence it in once and for all and be done with it.

normally without the neighbors permission, a fence has to be 6" off the line.

I kept mine 12" off the line, but it is definitely not a requirement with our township building code. I did it so that if I sprayed herbicides on the fence line there would be no problems with spraying 12 inches outside the fence.

I have always been told that you want to put the fence about 6" into your property. If you put it exactly on the line, then it belongs to both of you.... [ he has as much right to modify it or tear it down as you do ] Plus you have the problem of digging the post holes. You have to dig on your own property. You do not get to borrow or use land that you do not own. In olden times, farmers would put fences right on the line... but they would usually share the installation and upkeep of said fence as a common property border.

Also depending on the type of fence you may need to maintain the otherside. If it is right on the line how do you paint/stain it or otherwise maintain it?

We are building electric fence for the horses. We are putting it 10 feet inside the property line. That way we can ride out there and it is two mower widths wide. While the current neighbors are good people I would not want to have to move the fence if they move.

I have been repeatedly told that a fence installed "NOT" on the line,,, becomes the new line after a certain # of years.

Put it on the line,,,
