The problem with mj is that there is no standard for levels of thc testing for recreational use verses stoner.
What does ADA have to do with an employee going to work impaired?
Please, ADA is for people that actually have a disability.. ADA was put in place to protect people that needed reasonable accommodations to perform a job, it was not put in place to protect people that can't go without a drug that impairs the persons ability to complete a job.
While Noble in it mission and goals it has also spawned a cottage industry of lawsuits with some filing hundreds so that even California's Governor signed a law to curb them...

We were about to be cited because the soap dispenser was 1/4 inch too high on the new build... the wainscot installer in the bathroom miscalculated the finished floor height so a little quick thinking on my part adding a non-slip mat and all was good...
As a residential property manager the ADA has caused a lot of issues... I am required to allow reasonable accommodations but have had tenants demand a enlarge bathrooms and doorways on the owner's dime... this also has included ramps.
A huge problem is now every dog is now a service animal or some variations thereof...
Just about anyone can get a Doctor's note saying their child would benefit from a pet and often the pet of choice here is a Pitbull...
I have had dogs cause/instill fear in residents and been hamstrung because the dog in question has not bit or attacked anyone and the owner has a Doctor Note...
There was a time when these animals were the epitome of the breeds... true service companions... now the system is abused by anyone that wants to have a pet... I deal with all the time.
One of my friends designed and built a specialized Wheelchair... it was height adjustable to accommodate requirements of the workplace... he did well with it... this was in the early 1980's
My last wheelchair tenant did thousands of dollars damage to the unit... the electric chair destroyed everything from floor height to 30 inches about floor height... all the kitchen cabinet doors, stove, refrigerator, drywall, doors, bathroom fixtures etc... I ended up buying a very expensive toilet because her medical condition plugged the toilet several times a week...
When wheel chair bound and sedentary the stool is often hard as a brick... this is a medical condition but the toll it took on maintenance staff was immense... one unit with more service calls than all the other units combined...
Eventually tenancy was terminated... she was having trouble paying her reduced rent and asked me to file an unlawful detainer against her so she would qualify for emergency financial aid as a disabled person about to be without housing... so I reluctantly did.
After months of runaround the aid was not forth coming... it all proved very costly.
The ironic thing is I offered to forgive her back rent and refund her full security deposit and additional $1000 payment if she voluntarily vacated... she said the program offering assistance would be ongoing but only if I filed to evict...
When the Judge ruled in my favor she asked for the money to move and security deposit... I told her I would have been most happy to provide but it and more went to legal fees...
There were no winners...
And if a person in the same situation approached you for living quarters again, would you take it into consideration or would say to yourself, oh my god this is never going to happen again?
This is why I have been transitioning away from residential to commercial...
A residential operator here is mired in rules and regs… Just Cause Eviction is another one... no longer can an owner simply say sorry, I will not be renewing the lease... a reason from approved reasons must be given and filed with the city for response.
One of my older friends lives in the 4 unit building he owns... he has two units vacant and simply will keep them vacant until he dies...
The new twist is the extra $6,000 vacant property tax the city has... so he could potentially have to pay thousands each year to keep his units vacant... honest.
I lost a good tenant because another tenant with a medical MJ card and smoked frequently...
MJ use is very prevalent... especially among a set of younger people... have actually met people drawn to California because of legal MJ
