My neighbor moved in last summer. Started a BNB managed lodge and now does not live on the property. We have had easement issues (previously discussed here) and not on the best of terms.
While he was here we discussed if he knew wjere the property line was. He pointed out what the previous showed him and that was in line with the county aerial drawing. The property a few years back was surveyed and market but all is overgrown.

Last summer he moved in a shipping container. It was placed on the property line but seemed to be on our side. I let it pass because of how long the easement issue has taken (still not finished on that either).
I called the survey company a couple months ago to locate the pins set on the line. Last week they finally had time. The shipping container is about 5 feet from the property line and on our side. That puts the container and a pile of wood about 30 feet into our property.

It is placed noticeably into our property from the description he gave me so he would have done this knowing it was over the line.
I am writeing a notice letter in which I am including a picture of the survey pin and his container.
Notifing him of the survey
Billing him for the survey as well as charging him a monthly storage fee.
Also notifing him it needs to be moved.

Question is am I missing anything here as far as my rights?

I have serious doubts about successfully billing him for storage or the survey. Make him move the container and go on. Burn some brush and tragically let it get out into the wood pile. Can you update the other thread?

If I got a letter with a bill for storage and the cost of the survey I’d be inclined to throw it away. You and he have no contract or prior agreement for these services. Those actions are simply aimed at creating conflict with no realistic expectations of collecting money.

Writing a letter (or calling him) with a request to move the items should suffice. If the items don’t get moved in a time that is satisfactory to you, then go move the stuff. Probably need to hire a dozer or something to push/pull it. The next step is to build a fence down the line.

He did not ask for a survey, so I don't think you can charge him for it. He did not agree to any terms of storage so you should not charge for that. You can ask him to move the container and give him notice.

That’s exactly what I thought. I’d call the guy and ask nice and if that didn’t work I’d take my backhoe and shove it across the line. I’m glad the OP isn’t my neighbor. I know that if I was approached with such a ridiculous request I’d fight to the bitter end vs just dragging my container back over. 5’ could have easily been an accident but maybe the guy likes poking a stick on this hornets nest.

No way around it.

You had a easement to deal with with you bought your porperty, and your fuuked.

The reality is no matter what we idiots tell you what your options are, the added reality is YOU have to pay a laywer that practices in YOUR state to tell you what to do.

My advice (which is free) is to fricken move. That said, since you aren't paying me, you won't listen to me. I get it. You however, don't.

Yep...that right there is pretty close. ^^

Write him, send certified, tell him 30 days to move it, or storage charges do start to apply. I personally would NOT move it, because he might claim damage if you do....let him arrange for movement.

The survey cost is all on you.

Dosn't cutting down our trees, clearing the area and graveling it, placing the container and a pile of wood 30 feet onto our property seem like its (your words) aimed at creating conflict ?
By his own description of the property line he has knowledge of where the property line is and was nowhere close to his side.

By your other thread yes I think you’re a bad neighbor. But I was trying not to go there. Now if you really want to stir up trouble the trees is the best avenue I see to do that. The survey cost is all your dime. The storage fee will never go anywhere. You might succeed in suing him for the loss of the trees.
