So the guy put up the fence on the boundary, but didn't send you the 30 day prior notice and work out an agreement for its continued maintenance? And the next owner might tend to think it's a common fence and that you share responsibility for the cost of its maintenance even though there was never any discussion between you and the flipper?

Where is it written that a "30 day prior notice" must be sent when building a fence?

"(1) Adjoining landowners are presumed to share an equal benefit from any fence dividing their properties and, unless otherwise agreed to by the parties in a written agreement, shall be presumed to be equally responsible for the reasonable costs of construction, maintenance, or necessary replacement of the fence."

How the heck do you people live in that state? I'm equally responsible...... not happening. :talktothehand:

I haven’t researched it extensively but I believe it may be pretty common if the fence is on the property line and both parties derive some benefit from it.

In ultra’s case it sounds like he should look into that and consider a protest of the fence under no notice and no agreement. Otherwise could he become responsible for One half of maintence expenses to future owners of the adjoining property????? Might be good yo find out soon enough that there is time to remedy it.

Just cashed the check... so all is good.

Sure it would not have happened had I not been on top of it... the Realtor was dodging me so I showed up and had a chat with his broker... 3 days later a cashier's check appeared... amount is OK... I never try to hold anyone up...

Damage to my irrigation and the cost to replace the rhododendrons and Camellias I planted back in 1985...

I clearly showed the property line and that everything removed was on my side.

The fence that was built was on the line so nothing I can do about that... 10" between the side of my detached garage to the 6' fence the flipper built...

No fence set back requirements at all... most fences are deemed common fences and placed on the line in subdivisions...

The only fence constraints are in regards to height.

So what would you gain if he cut some off the top of the fence? You still couldn’t work between it and the garage. That sounds like a you problem for having a garage 6” from the line.
