Hope you can find a home for her. I just got into trouble for taking in the neigbors dog who he dumped off at the pound but told everyone he found a home for him, and we're past our limit of dogs, and trying to find him a home after training him some more.
I don't want to get off the subject and derail a thread, but I have to ask, was the only "infraction" of the dog nipping (assuming skin not punctured) a fed ex driver on your property that has her labled as "dangerous"? Has other strangers been on your property and did she have a problem with them? I just find it hard to believe that the government can lable a dog dangerous for one "nipping" incident. Heck, if that were the case, pretty much every little yappy dog could be in jeapordy of being dangerous.
Under Ohio Dog Law ANY injury a dog does to a person, the dog can be labeled as dangerous.
I talked with a lawyer specializing in dog law because I was gonna fight it in court. She explained it to me: The family dog can lick aunt susie on the hand, if aunt Susie falls down and cracks her hip because of it, that dog can be labeled dangerous.
My dogs are contained via a wireless electric fence, those collars won’t stop shocking till they come back to the house and I keep the batteries changed out, never a containment issue. What was delivered was not ordered, it was an advertisement that the company sent as a certified letter threw FedEx, the dogs were out when the unexpected driver showed up and the driver got nipped, no blood was drawn.
The driver went to the doctors to get checked out, the doctor reported it to the health department, the health department faxed the info over to the warden. FedEx didn’t report it, they were cool about it.
I explained this all to the warden and they labeled her as a dangerous dog, I was furious, but lawyer said it would be about $2500 in lawyer fees, plus court fees to fight the dangerous dog designation, the warden would testify, the driver would testify, I would have to get an expert witness (dog behavioralist) to testify she’s not a danger to the public.
In Ohio a person on my property is not a trespasser, I HAVE TO PROVE they are committing a crime in order to label them as a trespasser. So a delivery driver is considered a invited trespasser and is void from that label, I guess even if they weren’t invited. The dog can legally bite a trespasser and not get in trouble.
One thing is I have to have is a kennel, when the dog is outside she should be in a kennel, not to contain her but to keep people to be able to get to her. I have to keep people away from my dog so if they wander into my property even if they aren’t invited lol.
Ohio dog law is VERY strict against dog owners. The reason I’m re-homing GiGi, she’s a great little dog. BUT there is many kids in the neighborhood, Ohio is VERY VERY VERY strict when it comes to kids and dogs, it’s just too much of a liability to keep her, I have thought about re-homing both my dogs because of the liabilities. I was under the impression that as long as I do a good job keeping the dogs on my property I don’t have to worry about getting sued, boy was I wrong. The only thing I can do would be put a 8ft fence up around my property to keep people OFF my property so they don’t sue me when my dog guards the property.
