So if you have a dog you wouldn’t mind if your neighbor came over and served you with notice that you should get rid of the dog or agree in writing that the dog will never bark at night, bite anyone, crap out side his own yard or any number of things the dog might do to annoy, harm or inconvenience the neighbor sometime in the future and if the dog does any of these things you would be responsible.
Of course you would appreciate the neighbors gracious offer to help you rid yourself of the dog immediately least he become an unbearable nuisance at some unknown time in the future.

My thought was if not for that "arborist friend" this post would never have started.
Correct? Some guy calls attention to two (malfeasance?) issues on another's property and then leaves.
The OP should go to THAT guys place pointing out things HIS neighbors are doing wrong giving him something to worry and deal with!

Apples and oranges. Not even close to an apt metaphor.
No, I wouldn’t agree because if that dog got loose and came on my property and damaged me or my property, it wouldn’t be called and Act of God and the dog’s owner wouldn’t be free of any liability for those injuries, unlike if a neighbor’s tree falls on your property. Even when that neighbor has set up those trees to fall on your property.

Here’s a more apt metaphor:
So you’d be ok with a neighbor having a loaded rifle pointed towards your house with a trip wire tied to the trigger? As long as he doesn’t pull the wire he’s not responsible for anything that happens right? If an animal happens to walk by the trip wire, you’d say that’s just a natural occurrence and an Act of God?
How is this different than digging under the roots of a tree that might eventually fall on neighbor’s building?

I disagree with most of the comments here.
Yes, talk to your neighbor and tell him you are going to send a certified letter expressing your concern that the trees are going to fall, unless he:
A) Removes trees, or
B) Agrees in writing that he accepts responsibility for what happens when they fall.
Heck, it would be neighborly to help him remove trees.

Otherwise, in most states, when they fall, it痴 an Act of God, and YOU are responsible for the damage to your property by his trees that he doomed to fall. However if tree owner was warned, then its not an Act of God and they are responsible for damage.

Protect yourself first AND be neighborly.

As for the trees this is preciesly the problem. Best estimate is they would NOT hit the barn, but not 100% sure of that. Frankly if they fell on to my property and did NOT hit anything I'd likely just cut it up and have a bonfire and be done with it. However if it hits a barn we could also have dead horses. That is not a morning I want to wake up to.

Help taking them down now? Not coming from me, I know zero about taking down a tree other than I have the number of an arborist :)

Once it is down help with my tractor and chainsaw? Offer to burn the wood in my bonfire if no one else wants it for their fireplace/wood stove absolutely.

Have you seen this property? Have you any shred of credible evidence that the owner disturbed the roots to the extent you describe? No you don’t!

A tree falling is not automatically an Act of God but to be held responsible a property owner must be shown to have knowledge of the dangerous condition and a causal connection established. That doesn’t have to be a certified letter. And you cannot establish a casual connection for some event that might happen in the extended future based on nothing but pure speculation.

Go take care of your own dog and leave the guy with the tree alone.

Ask your insurance agent about acts of God on other peoples' properties affecting your property.

This is basic home/property ownership 101 type stuff. It has nothing to do with being vindictive, lawsuit happy, or anything like that at all. It's protecting your investment from the negligence of others, wether they intended it or not.
