I agree with you completely, if they were using recreational MJ. My concern is the use of CBD products that can cause false positives on tests and have everything to do with medicine and nothing to do with safety or job performance. Would you ask a guy to stop using his asthma inhaler also? Any other drugs he has to take for health?

We "drug" when we take a cup of coffee or anyone lights up a cigarette. It's all self medicating with drugs of some kind.

Sober at work. I think we can all agree on that.

Working in manufacturing Union Shop for a time I noticed the strict contrast... the Union Workers were held to high standard regarding sobriety on the job... yet management often wined and dined clients with the Martini Lunch...

Not all the world operates the same... Beer is actually provided Free of Charge for Lunch for BMW Union Auto Workers... Beer without limits... but accountability.

No one ever gave it a though when Auto Workers, Construction Workers, etc... have a beer at lunch... and often provided by the employer!

When I was building in Austria part of the budget included Beer... which I really questioned.

Then I was schooled that this is how it is done and "Required" with a much larger Beer budget in Summer!

I think the key will be drawing a line between off-site medical use and being impaired at work, just like we already do with strong pain meds or even alcohol. There’s a difference between having a prescription and showing up under the influence.

Also, more people are turning to things like cannabis oil for sleep or anxiety, and not to get high but to function better. In case it helps anyone researching this from a workplace or health angle, here’s the platform I check when I want a second opinion or product info on cannabis oil

I agree. While I think the prior post on coffee being a drug, technically yes. There is a difference between coffee and behavior/judgement/performance altering alcohol, pot, pain meds.
My thought is, if what legal drug you are doing negatively affects safety, performance, etc then you need to go home.
I hired an alcoholic as a chef. Always functioned as needed, but towards the end he started coming in drunk. I was walking behind him once at 6 am. He bounce off the wall several times, stumbling the whole way.
HR said I need to document, then councel, etc, but could not fire him. protected medical issue. All I could do is send him home, no pay for being a danger to himself or others.
He was a good guy. After we talked, he thought it best to move on.

And we know now how bad quality has become over the past 40 yrs with the Big 3 as well as Mercedes and BMW.

The officer showed great restraint. Trespass is trespass. Until the US Government decrees weed as a legal drug, she and anyone else caught using it on the job can be detained and charged.


Don't know if Amascon is considered an 'industrial' setting but I do know that in an industrial setting, using illegal drugs of any kind are grounds for dismissal and I'm sure in her pre employment agreement, the use of illegal substances wile on the job are expressly prohibited.

They are here for sure. The outfit I retired from, it's in their pre-employment contract as well as a pre-employment drug screen and my ex-employer uses the hair pull to determine it, plus all employees are subject to random testing. I cannot remember how many times I was pulled for a random. Lots of times.. Got the afternoon off with pay or morning or whatever.

Every time but one, you tell them, and they apologized and left (never mind they were inebriated). Once, a young guy came in drunk and started horsing around with other workers. Obviously drunk, not on the schedule, and rough horseplay. Someone was going to get hurt. So I told him he wasn't scheduled to work and he should probably leave. He says he wants to kick my ass and wanted to fight.

So, I told him I couldn't fight on the clock! :ROFLMAO:

He left.

Here, your best bet is to call a cab/uber to take them home (on your dime). We have dram shop laws and could be held liable if they got into an accident. According to our legal guy, the cab ride is way cheaper than his billable time.

The road construction company I just retired from after 38 years has a policy. Now remember this is Canada where pot is legal.
At any time while on duty or in possession of a company vehicle you shall NOT be in possession nor under the influence of ANY intoxicating substances. This includes anybody working on the ground, ie; flag people, foremen and supervisors.
I took it one step farther and decided that I would NOT partake of any intoxicating substance within 24 hours of driving, their vehicle, my vehicle any vehicle including rollers and other unlicensed engine propelled equipment. I am now retired and still stick to that rule. Impaired is impaired and we can lose our license for impaired operation of a motor vehicle when get caught. I will submit to a blood test anytime the cop wants me to as long as I hold a drivers license.

FAA says 8 hours between the bottle and the throttle.

I don't know about anyone else, but back in the past, I was often plenty drunk well past 8 hours after my last drink.

24 might be a bit excessive for a couple drinks. But if you felt buzzed, there's good chance you're still legally drunk even after that buzz wears off. Best not to chance it.

My class A license (CDL) was very valuable to me. It grossed me $50,000.oo/year and I only worked 4 months of any given year. Over 38 years that is 1.9 million dollars.

At one time I organized a monthly lunch where we would fly somewhere… one of the guys had multiple ratings and owned a p210 Cessna…

These were great get aways but he would never drink while everyone else was having a good time…

I miss those days and really enjoyed especially sitting right seat…

Still remember a highly decorated WWII fighter ace attended one trip and he raised his eyebrows when the pilot asked if I wanted to take the controls…

The WWII Ace said he could see his obituary of carrier landings, dig fights and ACE in a day going down with a 17 year old at the controls…

I can’t even imagine how things would be today because MJ is everywhere and used freely…

I really do not understand the lack of just the most common sense abilities.

because so many folks drive around with suspended licenses, no insurance, you name it, particularly near urban areas,
it's clear we have a whole class of bad citizens out there.
There seems to be a feeling folks have a right to drive, unlicensed, uninsured, dui, who cares, I've got my rights!
when did driving become a right and not a privilege?
when folks got to feeling entitled.
and there's some really stupid selfish people driving around out there, that don't care anything
about anyone else.

this is why I approach every intersection with a little extra caution.
have had too many folks drive through four way stop signs right in front of me.
hard enough when you are sober to make those necessary defensive maneuvers; if you are dui
you not only are more likely to cause an accident but you are probably more likely to not be able to avoid one
when it wasn't your fault. Less sight distance vision, more late braking, more keep it between the lines and that's all you need to do.

I think most of us have driven home at some point in our life when we realized we weren't in great shape.
Uber/Lyft is the answer. You just have to have it.
I imbibe in very little and am a senior who simply knows better.

just stay off your phones people and drive sober.
I'm afraid more common sense than that is wishful thinking for many.
Too many left lane Louises, too many tailgaters.

anyone who shows up at their place of business under the influence ought to result in a pink slip, but
maybe not any more. I got my rights! ;)

You got a good point Drew.
You have the right to show up at work ready, willing and able to do the job you are getting paid to do. That is what I live by.
Yes, I drink, not near as much as I did from age 15 through 40. I tried doing what the sign said, "Drink Canada Dry". Didn't work. I got sick and tired of waking up sick and tired.
Just because I am retied now, doesn't mean that I will revert to my old ways. A 24 bottle case of beer now costs $50.73. Back in 1981 it was $10.75. I could afford it back then, not now.

look at the price of a retail pack of cigarettes

I'm a retired CFP and it has always pained me to get in line, when I was in NC, at the supermarket and see all these poor folk
buying cases of beer, cartons of cigarettes, and usually several cases of Coke or similar. And yes add bags of chips.
it wasn't a cliche...it was real and a lot of it.

does get back to the core comment of using common sense.

btw, the green stuff costs about 285 an ounce locally, in NJ.
It was about 190 in California so transport cost not bad.
used to be 400.
