Does anyone know the procedure to appeal the denial of a Kubota warranty claim?

Issue is complicated and lengthy so will not try to explain details here but certainly something that Kubota would not deny if all of the details and the sequence of events were known by a person having the authority to reevaluate the situation. Need to speak with a person rather than a computer.

Thanks, RC.

BTDT earlier today (both by telephone and website (electronic)) and have not yet heard back but Kubota service representative called me at home after telephone. His reason for denial has changed somewhat but still a denial.

FWIW, my dealer has advocated for review but now tells me that there is nothing more that they can do. I do not consider this my dealer's fault. They have been put in a no win situation. Nevertheless, it is certainly not my fault.

I sure would love to hear the story behind this. Even if that meant private messaging me. The only reason I could see them voiding your warranty would be that you modified the vehicle in some fashion they took it outside of its normal expected operating parameters. in my world of automobiles and performance I understand that if I put a tuner on a car, or do anything to make more speed or power than what the car was originally designed that I have no right to expect insurance or warranty whatever you want to call it. But if I buy a vehicle, being a tractor or a Corvette, I would expect it if I left the machine as the engineers designed it that anything that I do within that operating envelope should be covered by the state of warranty without much argument at all?

Sorry to hear this SDT, assuming it is related to a previous post? The B3350 has been a real disappointment. You would think if they switched to a common rail engine in their upcoming model that they would take care of anyone with issues on older models.

The issue is detailed and explaining it would be time consuming so I will not do so here.

Kubota is not voiding my warranty, but rather, denying a claim made by my dealer.

Sorry to hear this SDT, assuming it is related to a previous post? The B3350 has been a real disappointment. You would think if they switched to a common rail engine in their upcoming model that they would take care of anyone with issues on older models.

I have spoken to my regional technical representative multiple times. Though incorrect, he is adamant in his position and not willing to reconsider.

I'm trying to escalate it beyond his authority.

I'm certain that this is possible but doing so is intentionally difficult.

It's a $300 claim, and certainly not worth such.

Though I'm, an attorney (retired) and know how to do such things, I will not involve any kind of legal or media tactics. It's just not worth the bad blood that would result.

In the Automotive World I know individuals that have escalated and persevered to the desired outcome.

Escalation to the top of the corp. hierarchy has worked... as has action under Song Beverly and Magnusson-Moss...

Sometimes just going through the motions will be enough...

I helped a retired friend with a warranty dispute that was right on the line... GM corp. refunded the cost of the part and everyone was pleased.

Another, with fuel problem got no satisfaction and went all the way to Small Claims... he was a retired Nave Commander and took this on as a personal crusade... I went to Court with him... Dealer and Manufacturer denied all the way... the Judge was impressed by the extensive paper trial and exhibits that were bound and in triplicate...

When it was all said and done... he was awarded and collected $1200 back in 1980's...

I'm escalating the issue only to try to help my dealer who has been placed in a no win situation by Kubota's denial.

If, I am unsuccessful, after sending my letter, I will drop the issue but will likely reconsider my plans to buy a M5-111HDC24.

By the same token, shouldn't a major corporation see the value in paying a $300 claim vs bad public relations and the possible loss of future sales?

I am curious about one detail. Is this denial on a tractor that is out of warranty or within the warranty period?

And further... If it's a measly $300 valued product failure, why wouldn't the dealer just eat that and move on regardless of the official warranty. I'm the automotive world this happens frequently, it's referred to as a "good will warranty" where the dealership eats it to keep the customer happy.

The tractor currently has about 20 hours on it and is well within the warranty period.

If it were me, I'd be makin' a fuss one way or another. Maybe not over the $300 issue, but the possibility of future handling of other issues that might come up.

Than you have to give us something. They have to have some reason that they are eluding to as too why this 20 hour, brand new, warranted and broken tractor is not going to get warranty coverage. Otherwise, you pretty much look like your being deceptive to us by claiming that Kubota who is notorious for great customer service and great products is suddenly turning evil and is out to get poor old you for no reason whatsoever.

Your holding back critical need to know information, and my suspicions are that your doing this because you know in your heart of hearts that they are in the right and you... Well you are not.

I could be wrong. If so, I'm sorry for thinking this way. But as it stands I'm going with my gut. Your trying to pull some shady crap.
