On the flip side of the equation, let's consider that this 3PH is "normal" for an L-series tractor. This means they'll be unable to do much to change it.
Will they upgrade you to a GL3940 free of charge since there's nothing really "wrong" with the L3800 you have, it's just the way they are?? I very much doubt that, I know I wouldn't if I were the manager of the dealership.
My line would be something like this..
"Mr. Germ, I can't apologize enough for our salesman being mistaken about the hitch on the L3800 you had. It looks like there isn't much we can do to cure it.
In fact, I feel badly enough about it that we're going to cancel your contract, take the L3800 back, no charge to you. We'll put it on the lot discounted a couple hundred bucks as a "demo" unit.
Now that we've got that behind us, if you'd like to look at something a little smoother, we have an L3940 over here for "X" dollars. Same horsepower, more bells and whistles, silky smooth hitch, more loader capacity, really nice tractor.
Of course, it's going to be a little more expensive, but you're really getting what you pay for..."
You see, the lack of a signed contract is in their favour as well in this case. They aren't obliged to do anything at all to the L3800 you have, since they still own it.
The thing is, unless there's something actually wrong with the one you have, the L3800 is still a great tractor for the money, rough hitch or not. It's why I haven't traded my L3400 in on a GL3540. It's not a deal-killer in my case, I can live with it as a trade-off for all the good things about the tractor I have. Primary good thing being the bang for the buck.
A GL3240 isn't equivalent power-wise to a L3800, it is directly comparable to an L3200 which is about $1900 less than the L3800 as I recall.
