You don't need a lab in Florida. You can use any of them. They'll send you sample containers and the whole process is done my mail.

One I've used a number of times in the past is -

Terry Dyson at the first link can tell you exactly what's up with the engine. Any number of people have used his services in he past to "persuade" dealers to do warranty work that they didn't want to do.

If it were mine, I'd be printing out this thread and taking to your friendly local attorney. Given the number of known problems with these hoods the whole thing looks like a slam dunk in small claims court...

Yes, this does seem to point in the direction of a "legal issue". Simply resolving the issue or giving me a refund would save him a lot of grief. I have to find out what "laws" apply in FL to the "buyer beware" when it comes to equipment. If it was a cheapo mower I wouldn't be so upset, but having a $4000 mower made into a flower pot in my yard is not a good thing!

I also noticed some of you have mentioned a "THREE YEAR WARRANTY" ??? This jerk swears it is only TWO YEARS, not a day more.

Is the length of the warranty applied to a purchase strictly the dealer's choice? If so, then I guess it is very important where you buy your equipment!

After talking with the dealer, he "supposedly" has a meeting in Jax tomorrow with Cub Cadet. Then they will make a decision as to whether these items are to be warrantied. This is so insane. They refuse to acknowledge all of the discussions on this website! Claims we are just a bunch of opinionated people ranting off .... :mad:

I am to the point that if I met up with these people in Jax, I am sure I would lose all poise and kindness and that would be a bad thing :D ... nowadays they put you in jail if you lose your temper, whether you were "in the right" or not!
I wonder if I hauled it on the trailer up there with large signs on both sides "I got a pair of lemons ...both the mower and the dealer, how about you?" It would look plumb purty parked at their front door! LMBO! :p

The dealer doesn't warranty the product, the manufacturer does. The dealer is the manufacturers representative to provide along with other things, warranty services. The dealer doesn't determine length of the warranty either, the manufacturer does. It's a manufacturers warranty, not a dealer warranty.

In the beginning you probably had a common Cub Cadet with the hood assembly problem some have seen that should have been promptly taken care of by the dealer under warranty.

But due to a bad dealer you also have a machine that in all likelihood wasn't serviced properly in the beginning. At that point I have to believe some responsibility shifts to the dealer.

They can refuse to do warranty service to correct manufacturing defects if they choose. That's between them and the manufacturer. But they can't get out of the responsibility for any work they've done on the tractor.

See a lawyer...

You all have been very helpful and I just wanted to say "thank you".

Seems this issue is just going to keep being a tall, tall tale of lies and alibis from the dealer and the "no show" Cub Cadet Territory Sales Manager - Mr. Austin Monroe. Going on FIVE WEEKS of my equipment sitting in their shop. They took the shocks off the hood so it would close. Smart way for other customers to NOT SEE the problem ... just a pretty, sparkling clean mower sitting there as if nothing is wrong.

Hm-mm... I think the Cub Rep. must be enjoying the lifestyle common with many who live in Jacksonville, FL .... the beach & boating & the ladies & party central from Thurs - Sun .... guess that would beat out "customer service" any day of the week! :rolleyes:

If that's the case, I hope his boat sinks - just after the motor starts knocking and smoking like a freight train :D - keep "doing unto others" and you never know when the good Lord might see it gets done to you! (Those expensive lessons many of us learned in our younger days.)

Yes, I keep getting the run-a-round from the dealer. He says the decision is the Cub Rep's responsibility. The owner of the dealership is the real jerk, he refuses to do anything and is very obnoxious. Good thing he wasn't the salesman or I would have waved goodbye and drove the 50 miles to another dealer.

Yes, Southland Sales is listed as a Cub Cadet sales and repair center on the CC website. I also noticed their "catch 22" pertaining to repairs:

"If a Cub Cadet product needing service was sold through a national retail store chain, such as: Home Depot, Lowe's Home Improvement Centers or The Tractor Supply Company, then that retail store should have service contact information available for a Cub Cadet authorized servicing dealer, that has partnered with them locally, to provide Cub Cadet service and support for their customers.
NOTE: Independent Retail Cub Cadet Dealers and Service Centers are not obligated to work on all Cub Cadet equipment. Many of these independent dealers only service those products that they sell. Although these independent retail and service centers are encouraged by our company to perform service for all Cub Cadet customers, as independent businesses they are not under any obligation to work on Cub Cadet products that are not purchased from their store."

This puts people like me in an awkward situation. I wonder if other people have faced this same issue when their dealer is horrible and they have to locate another repair facility?

And thanks for the advice concerning the State Attorney General and The CPSC. I sure have learned a lot, so much reading of statutes concerning this kind of stuff, I think I my eyes are going "buggy" - :p ! I don't trust lawyers any further than I can throw one, so I am doing my homework before I sit down for some serious discussion on my legal rights and that happy stuff that going to court will entail.

I'll keep ya'll posted. Maybe my learning experience will help others. ;)

Good luck with your MTD/cub cadet warranty issues. I have been down that road. Fortunately, I had a good dealer to work with (Too bad the product was not half as good). The dealer dealt with a rep at company headquarters and also arranged for me to speak with this rep directly. Very long story short...MTD did the right thing, it just took them a long time to do it.

I learned my lesson. No more Yellow!..I now own Green!:D

He saved enough $ by not buying green, he's still ahead even if he needs to buy a new hood and a new engine. :p :D

Yes, he did save $ by not buying green. It sounds like he has had a wonderful ownership experience...:rolleyes:

The dealer really matters on these items. More than the brand IMO.

When I got my 2554 the dealer was great and they still are. I also looked at some green models before I made the purchase and the dealer was "way too busy" to even spend 10 minutes with me. That's the same green dealer that charged the neighbor $68 for a deck belt for his new JD 455 after it lasted less than 20 hours.

"Belts aren't ever covered under the JD warranty." Even if it is part of a brand new lawn mower that cost in excess of $10,000.

Both neighbors that have green were the most vocal about what to buy when I got my Cub. And neither recommended JD.

Go figure...

You mentioned taking a tape recorder to the dealer and recording the sound of a new engine. Please be aware that it is a crime in Florida to record someone's voice without their permission, so make sure you don't do that, even inadvertently. They have actually prosecuted public officials for tape recording a public meeting and not getting the permission of each and every speaker.

And just in case KendallXX sees this post and has a fit, I will state that I am not a lawyer, and this is not legal advice, and I did not stay at a Holiday Inn Express last night -- or ever, for that matter.

Gone are the days when Cub Cadet hoods were made of metal and the front of the tractor that the hood sat on was made of cast iron....:( They might have rattled a bit, but they sure didn't melt.
