Exactly. Speaking as a real estate broker, any sales contract should have the terms all spelled out. If the land is leased, and the buyer didn't know that, then it time to call the real estate association and file a complaint. Getting the value of the emblements is nothing in comparison to what the real estate association and state commerce department can get out of the two brokers involved in the sale.

BTW, If he gets 40 bushels per acre @ $2.50 per bushel on 5 acres its about $500 total we're talking about.

  2. If it's not spelled out there, ask a lawyer.


Any other course of action is foolish, especially calling the previous owner and asking him.

who is liable if somebody gets hurt?? :confused:

If it were me,,, I would let everybody know that I bought and own the place,,
I would give them 48 hours to prove they own the crop, and are properly insured.

Otherwise,,, I would be spraying Roundup to resolve the issue.

A neighbor DEMANDED that I give access to my property so that he could fix a cattle fence.
The neighbor had his lawyer send me a letter.

I called the lawyer, and told him the neighbor wanted to bring trucks and tractors on my property.
The neighbors lawyer agreed with me that I could not allow the vehicles on my property without incurring liability.

The lawyer called the neighbor that had hired him and told the guy NOT to take any truck or tractor on my property.

We agreed that he could step over the fence as necessary to fix the fence.

The fence was never fixed!! :laughing:

(NOTE: the reason the guy wanted to drive on my side of the fence was that his side was grown up in weeds,
neglect on his part caused the WHOLE problem)

One thing not said so far is the state may had a law on crop that is not needed to be written into a sales contract. Call the real estate rep it is their issue I think. The agent is responsible for providing such info. kt

I vote let the farmer come and get his crop. I'd bet if we were on the other end of this, we'd want our share of the crop.

May be the right thing to do is ask the previous owner who he had plant it. The farmer may not have been informed of the sale but he, in good faith expects his contracted share. The farmer may have no legal right to it, but is stuck in the middle. He comes back and harvests it and now splits it with you. just thinking of the farmer who is the one that gets the short end of the stick.

I look at it this way. Regardless of the legal aspects of it is a decent stand of beans is a lot of vegetation. Just plowing it up ain't going to go too well. It will need to be shredded, and plowed several times to get rid of all the stubble. I would be glad to have them harvest it to help you along in the process. How far away is harvest in your area? I could understand wanting it done now if it was months but if it is soon why not let him cut it? Makes your job easier. Who knows he may have big farm equipment and offer to plow it up for you afterwards or help you out in some other way.

Is this just five acres stand alone of beans or is it part of a larger field that you just bought part of?
