You have the main problem figured out. I believe we need laws to somehow get the bad doctors out of there. You good guys are great and I don't see how you do as well as you do with the lawyers and us ungrateful patients who won't take care of ourselves.
My hat is off to all of the good doctors of the world.

I also believe that the greed and stock market losses of the insurance companies figure into the malpractice rates.

I believe you're right. A friend of mine is an insurance adjuster. He told me that the insurance premiums don't cover the pay-outs. The premiums are merely a way to get your money so they can put it to work in investments. In turn using the combined premiums and investment interest to make pay-outs. In other words, the payouts must be less then the premiums plus what they make on interest from them to be profitable. Obviously, if the investment market tanks, then they're in trouble.

While I can certainly sympathize w/ the comments about lawyers and such the point is that events such as are documented in the lead post should never have happened. In other words we're our own worst enemy. In this case its a pointed lesson on why careful maintenance of equipment is so important -- if its broke, fix it. I've witnessed bloody accidents caused by use of broken equipment and in every case the user was focused only on getting the job done. In retrospect the time and money to fix the machine was far less than fixing the person...and considerably less messy.

Several years ago I sponsored a boy to come to the US from Russia to do some grad work. He was amused (understatement) about all of the warnings we have like "caution you can be burned by this hot coffee; "caution putting this plastic dry cleaning bag over your head could be deadly" and now the though of having to put lables on fast foods - "caution eating 10 big macs can make you fat!".

I told him Americans did not understand Kruscheive's meaning when he took of his shoe and banged it at the UN saying " We will bury you (US) and we will never fire a shot!"

Now we know it was by TRIAL LAWYERS!

Why didn't this hay baler putz sue his shoe manufacturer? Shouldn't a Nike be able to stop a hay baler from sucking in his arm? Why not sue his mom and dad for not giving him the proper genetic makeup to form a more durable arm?

Too bad he didn't use his "groin" to feed the hay baler. Maybe then the "Darwin award" could be issued and another idiot's gene pool would be removed from society!

Sounds like he paid a pretty high price for his stupidity. The fact that he decided to sue because he's a idiot makes me think if it happens again, he should not waste time trying his shoes, he should try stopping the machine with his head.

Hugh what part of SouthCarolina are you from? I was hatched out there 24 years ago and my parents lived there about 9 years in Bamburg before i came along. Back on the subject of safety I had a customer that i do backhoe work for try to sue a fella for selling him an ld golf course reel mower. It had Jammed on him when it had kicked up a pebble and the tractor he was pulling it with a Sears mower. When it jammed that section locked making a drag mark in his yard. He got off the tractor that was pointing downhill and went back to the section with his bare hand reached between the reel and the shearbar and plucked out the stone. It took off removing his right pointer finger. The reattached it he tried to sue the place that sold him the Lawn tractr, the junk dealer that sold him the old gangmower and the hospital for his now funky looking finger. Now when he calls me wanting work done ill refer him to my competitors.
