Screw 'em! This is Texas, if they break down in front of your driveway or the car is on your property all you have to do is call a wrecker. They will call in the license plate number to see if it's stolen and have you sign a private property towaway ticket. The last two I had towed came back stolen, that really shuts them up. It's legal and they have no recourse. Build the fence with heavy posts, that way you can turn it into a twelve footer if they give you any problems. That is legal, too. It's called a "spite fence". I usually talk real nice to people that give me problems like this and put up with their crap for a while, that way when I finally have to dump on them I can lay a guilt trip on them. Most the time it stops revenge problems. Some people have to show you they've been there longer than you and will calm down and actually turn out to be good neighbors once they get it out of their system. A lot of them, however, are flat out idiots and need to be treated as such.

Thanks for the backing on putting up the fence cstocks.

I just hate to see good folks taken advantage of by bad neighbors. Unfortunately sounds like that's could happen to jonh4nh.

Never understood why some folks had a problem with fences being put up - especially in a rural setting (if for nothing else, you gotta keep "Bessy" on your place somehow. /w3tcompact/icons/tongue.gif)

I have good relationships with all my neighbors, course I got good fences too, like you point out. /w3tcompact/icons/wink.gif

I also had a "difficult" neighbor with an abandoned house and rusting cars, combine, etc crossing into my property when building my fence this summer. Although the property was surveyed with property stakes when I bought it last year, the property line with this neighbor, ~ 1/4 mile, went through woods that he thought was totally his. The old boundry line road was 20 to 30 feet in on my property. I hired a surveyor this spring to mark the line through the woods with markers every 50 feet or so. Then we bulldozed a new road through the scrub trees. We cleared all of his debris back onto his property and, with the aid of the dozer any my pallet forks, moved the cars and combine back to his property. Only comment from him was that one of the old rusted truck bodies wasn't his. I crushed it and hauled it to the dump. Fence looks great now, about 6 to 12 inches inside my property line so I can keep it clear of brush.

The Head is really just a sprinkler that has a spray radius of about 30+-'. With it being about 1' off the property line that would be about 14'spraying on my side of the property line. That is why it is a problem; Imagine mowing walking by my son playing whatever and the thing kicks on automatic, and you get wet!!!! Its supposed to be treated water but who wants that crap on them much less someone elses sh***y water on their property!

Thanks for all the common sense posts, I do belive a good fence will make these people good neighbors..

As to the subject at hand. The wonderful thing about the law is it enables one to do the right thing without being the bad guy. The judge becomes the bad guy and both parties can claim victimhood.

The fence should always be put where the survey says. It should never be altered to accomodate a relationship. Folks die, change, divorce, remarry, have kids, etc.

From a fenceman's perspective I always encourage putting the fence two inches in on my customer's property unless the cost is shared by both landowners. If the fence is put on the line then legally both parties own the fence. A spitefull neighbor can paint their side pink with purple stripes and all the other party can do is complain.

I have put in fences where the one neighbor watched us like a hawk making sure we didn't step over on to their property even to the point of having a man pulling the dirt from the auger as it fell coming out of the hole.

As an old fenceman I can tell you that something I've observed is not viable in this situation I'm sure. But I've noticed more than once that the most combative fence wars have been when the parties were just too much alike, sorta like pink shoes and an orange dress....../w3tcompact/icons/laugh.gif

had a problem like that several years ago..the neighbor ran his drain line onto my dads place..one day in august, i was walking around with my daughters, and came across mud in the pasture, i did mention it was in august, right??? well, we had to get the state health dept involved to get them to move the drain. of course the dog pen they have is right on the property line too, and all their empty dog food sacks and cans are just chunked across the fence...and this is some prominent folks in the community; my dad had 12 acres, they had 9, plus some of dads for use of course.

HEEHAW,

Thats what Iam trying to avoid. I may want to resell or build and I need these people to understand. What they bought with there hard earned money they deserve, nothing less certainly nothing more.

I believe I reported back that they had removed the one car. So yesterday I ran a stringline and a couple of poles to show them what else was on my side half another car. This morning when I woke up to my relief they had moved the other car. I wish I could understand why they are mad. Iam really surprised how much this has stressed me. Hell Ive had dream bout fighting over this stuff. It just kills me that you know what you bought when you bought it and had several chances to buy more land, then when someone did expect to keep using it like your own.

Harv I guess this guy and I are different. I wouldnt be pissed cause you wanted your land. Course I wouldnt be on it without permission in the first place. Dont know how else to put it. I do appreciate the advice on the setback I may just do that.
