Personally I think there is no such thing as a to strict a DWI law. You drink and drive you should be locked up and locked up for a long time. I have 0 pitty for DWI scumbags. I have had a couple of friends killed by DWI drivers over the years and having towed away dozens of DWI accident vehicles over the years feel the law can't punish them enough. It wouldn't bother me if they made it illegal to drink anything before driving. I to like many others here have a CDL and if they ever cought me with the slightest wiff of alcohol on my breath wouldn't have a problem if they locked me up and revoked my license, I would deserve it.

My second cousin and his young wife had just finished college, had a 3month old daughter, and was with friends at a cook out when they decided to go out to get some ice cream for their party, they left their daughter with the friends. While on the way to the store while going through an intersection a drunk ran the red light hit my cousin and his wife at a high rate of speed, both my cousin and his young wife was killed instantly leaving behind their young daughter an orphan, a good thing that they didn't have their baby with them or it would have probably been killed also. This drunk had had other dui convictions in the past, but this time he left two devastated families. If the laws that we have on the books are being given to the fullest and they are having to serve the max for these repeat offences, then maybe the penalty needs to be increased, or a penalty imposed on them that would inconvenience them to the point that they would change. There is an area that I have to go through occasionally that there is no reason for a speed limit below 55, but yet they have speed limits that are constantly changing. The speed limit will be 45 mph for maybe 1/4 mile and then it will drop to 35mph, and another 1/4 mile and it might raise or go lower but any way they watch that area like a hawk and any minor breaking of the law will get you a ticket and people know it, and they know a ticket will hit them around $200 so people obey that law to the letter. If the law hits them where it hurts then their behavior can be modified. Talking about slightly being over the limit but not showing any signs of being impaired to treat that person the same way that you would a person that has demonstrated a total disregard for the law is wrong even though the law has the right to impose those penalties, and a person should be aware of that when they choose to drink and drive.

My father and I were hit head on by a drunk driver a couple of years ago. My dad would have died likely if the EMS hadn't already been within a few hundred feet responding to a fire. The driver had a previous conviction for DUI and only lost his license for a year for this one. He did go to jail for 4 months because he punched out a police officer who tried to help him out of his mangled truck.

So no. I don't think the DUI laws are too strict.

close by. the drunk that hit me had four previous convictions.

He got 2 years 6 months in jail.

Actually, in the US, anything 6% alcohol or over is not beer. It can be called ale, stout, porter or malt liquor but not beer.

Depends on the state law and maybe Federal laws/regs. I have not read the NC laws on this in a few years but I think above 5-6% beer is malt liquor. But I call it beer. :D

So, it takes a REALLLY BIG man to share a story about being arrested for DUI, yet you comment that you have 0 pitty for DUI scumbags?

So, if a man like Eddie Walker were to actually kill a man while driving impared (which he hasn't, nor am I implying so), yet be able to contribute to this forum after the fact, and admit to the fact that he killed man and realized his mistake, would you still think he was a big man?

There was a story in the paper, maybe 4 years ago about a repeated drunk who had been arrested for DWI. After the second arrest his state of Virgina I think I read that he had to serve mandatory jail time....well after the fifth arrest he was sentenced to 7 years in prison. Got released, several months later he ran head on into a mother and her three children and killed them all. So much for jail time for multi-repeat offenders. I have absolute zero tolerance for this type of behavior. What in the world can you do with these type of people? Lockup for life? How do you keep someone of this nature from obtaining booze and driving? It takes a real man like Eddie to get the wake up call, smell the coffee, and change his behavior. But these others, what in the world can you do with them???

Its a shame a family having their live took away from a SCUM BAG

like that. the answer to take care of SOMETHING like that is EXECUTION.

I have read and enjoyed many of your posts in the past, but a summary excution on the spot seems a bit much, if you dont mind me saying so ! You obviously have a zero tolerance towards alcohol period ! Thats fine and I asked you for your opinion just like everyone else, so Im not going to berate you for an opinion. But please let me ask you a question. If you had a young son or daughter that had made a terrible mistake, and got behind the wheel while drunk, can you honestly tell me that excution on the spot would be a suitable form of punishment ?

When I was in grade school many years ago, I remember reading about life styles and cultures in Afganistan. In that country many years ago, if you were caught stealing, they would cut off your right hand at the crime ! :eek: The problem with that was that you needed your right hand to eat out of the community food bowl, you could not use your left hand because it was used .... well lets say to perform some inmentionable tasks ! So if you didnt have any family, your fate was probablly starvation ! Sounds pretty Draconian to me, along with your endorsement of death at the scene of the crime ! If it was my son or yours I would feel the same way ! Stiffer penalties maybe, but when the prisons are loaded with career criminals that have raped and murdered watching color TV, your going to have a hard time convincing many of that form of punsihment !

I haven't read all of the posts on DUI, but am glad to see that folks tend towards stricter punishment.
I will never be able to shake the pain and image of myself lying in the gutter very banged, bruised and bleeding, with a very drunk man standing over me, asking me to please not involve the police because he had only had his drivers license back a short while after having lost it a year earlier for his first DUI. He had just run me down in a cross walk without his head lights on.
I think that the European model seems to work the best. Most European country's take your license for life after the first offense. The rate of DUI is almost ZERO. I am appalled when I read about people who are given their 3rd, 4th,5th, or 6th DUI. Imagine if you took a loaded gun out in pubic and began shooting it off in random directions. You would be locked up the first time, whether you hit someone or not. DUI is Playing Russian roulette with a car and your fellow citizens.

Good Evenin Guys,
Im just sitting in the kitchen with Kathleen this evening discussing the DWI laws in our state, and of course the group that spearheaded much of todays legislation, MADD. We both have some very mixed emotions on this subject, we seriously realize the need for reform when it comes to drinking and driving, but has it gone too far ? We worry about both of our young adult children, 25 and 27, both boys, both college grads, and hope that they excersize good judgement when it comes to going out with their friends on a friday or saturday night ! My youngest boy is a career fireman and my oldest boy is a volunteer firemen and holds an excellent computer science job. They both need their licenses to go to work and function in society.

I hold a CDL license, which in this state, you are considered DUI witha .04 BAC. I would never have a drink while driving commercially, but it is nice to have a beer or a glass of wine with your dinner when you go out to eat. Unfortunately that BAC applies even if your driving the family SUV !

While I have been fortunate enough to never have had a loved killed by a drunk driver, what a horrible thing that would certainly be, I also hope that my kids never get caught up in the system and have their lives ruined by todays laws !

In conclusion I think the laws need to be adjusted just a bit. I would like to see just a bit of liencency when it comes to some one consumming two beers, rather than be taken away in the police cruiser and have their life turned upside down. This is just my opinion, and Im sure you guys have your own feelings on this subject, please feel free ! ;)

First of all I am sorry for anyone injured by a drunk driver, including Johndeere4300 !

With todays laws no one is getting sent away for 20 years after consumming 2 beers ! That was a previous post and proposal by Johndeere4300 that I copied and replied to his previous post !

My wife and i where hit from behind this past fall going out to dinner while sitting infront of a stop light ! We never knew what hit us because this bozo didnt evnen have his lights on ! He wasnt slightly impaired he was totally drunk !!! So believe me when i say that I want drunks off the road as bad as anyone else !

I still feel that I should be able to go out to dinner with my wife and have a glass of wine and not be pulled over at a roadblock and be considered impaired !


(NO YOU STARTED this thread out with two beers.

And we know that no one is going to jail for 20 years, i said i thought
the law should be that way

I would love to be able to drive a truck again,especially when i would
get a load of Tractors out of Iowa headed east bound. But i just have
to stay home.This accident put a toll on my whole FAMILY, their is inlaws in my family on my wifes side that are jealous of us. WHY?
i guess because they didn't get hit head on by a drunk. and they all
have the best jobs you could get. I had to get me a laywer the best
their is and i collected.

I need a fourth surgery on wrist,they might even take it off,was told.
