Backhoe as a Motivational Tool

I don't understand the assult charge. Assault would seem to indicate that you were intent on doing somebody bodily harm. If that was the intention and you were using a Backhoe I would think that the harm would be emmediate and severe if that was the intention.

Since bones were not crushed or limbs amputated and stitches were not even needed perhaps the backhoe operator needs to work on his operating technique. If he was trying to hurt this guy he failed misserably and needs to try harder the next time.

On the other hand if he was just trying to get his attention I think he screwd up and somebody should head slap him and make him prommise to never do it again.
