General reply to many subjects. Where the 'law' is mentioned it is specific to my state (Wa)

Tickets for being dui in vehicle sleeping/pased out/just sitting - yes, many states have this law. If the key is availble to the person he can be ticketed. Here it is "presumptive control" but rarely used as getting a conviction has proved to be difficult.

Carrying a weapon on private land during hunting season. Here it was (might still be) required that you have a hunting license if you are wandering around your own property with a weapon no matter what you are doing or what that weapon is (not sure about hand guns).

Seeing deer from tractor? Used to get my annual deer that way. Like shooting fish in a barrel. As long as the tractor is moving, you can work right up next to a deer. Have worked up to within 20 ft and even stopped without spooking them.

In Kansas about 20 years ago, I took my 2 boys to my aunt's farm to shoot blue rock. She owned 80 acres that no one live on and we drove to the back of the property to shoot. A local game warden walked all the way to the back of the property to see what was going on because of the shotguns firing. He could tell that the boys were young enough not to need hunting licenses. I was throwing the blue rock when he approached us. He said that he wasn't going to check my license because I wasn't shooting-but that I did need a license to be shooting blue rock. This was during quail season but we weren't hunting. I had a license but didn't know of this law. Anyway, he said good luck to the boys and walked the 1/4 mile back to his car.

Yep. An ol'boy over in Roseville lost his license due to age so he used his lawn mower to drive around town. Last spring he picked up a 12 pack and headed home but decided to have one on the way and was fined for consuming alcohol was operating a motor vehicle.

i know of a case where a tractor did not meet the definition of motor vehicle, therefore insurance was not available topay the claim. If not a motor vehicle, then seems the criminal law would not apply either.

I would guess that if a loaded gun on a tractor is against the law the same would apply to ATV’s. Here in Georgia that sure would upset some good old boys. /forums/images/graemlins/mad.gif

The Regulstion book for Ga. states that it is unlawfull to take game from any vehicle while under power.. The saftey issue or probable intent is what would get you here, I believe.. Honestly, I'll continue to take my chances though. I have always believed that an unloaded gun is a hammer... /forums/images/graemlins/grin.gif

Beyond the power vested in their badge, they have all the power you allow them to have. Virtually every lawful entry requires probable cause. Fish & Game cannot go door to door looking in your freezer for illegal game just because they want to. Nor can they enter posted property just cause they want to. Post your property "permission required- F&G - this means you too". Continued entry is harrassment & tresspass. It has the added benefit of forcing them to do their job when you have unwanted guests. In New Hampshire all property is open to public use for some uses unless posted otherwise.

Nice thought..... Have you ever told a cop "no"? This only makes it more difficult on you. I do agree that you cannot give them ultimate control. However, if you feel harrassed you can file a complaint. By telling them no, they aren not allowd to enter your property, you have given them probable cause. Bottomm line, if you arent doing anything wrong, when they enter and see nothing abnormal and they are welcome, you will likely never see them again... Sorry, dont mean to be argumentative, I just dont get the anti law isolationist ideas we have sometimes..
