Talked with my attorney handling the estate yesterday and he is going to petition the court and request that all property of the estate be set aside as exempt since its probably not worth more than $10,000. He is probably correct in this since later in his life my friend didnt take care of his things at all. The BX has several issues that need addressing such as the hydrostat fan, most all hoses need replacing and the FEL and BH, but I'm not going to put any money in to it until the estate is closed and all is said and done.

We have court day today. We hope to have estate property set to 'exempt status' in one motion and in another motion we hope to get permission to sell items such as 5th wheel camper, Ranger pickup, boat, and several trailers.

Judge didnt grant permission to sell. Now, the estate has to pay for an appraisal on the camper, pay the attorney to take it before the court THEN hopefully get permission to sell.

Sorry it went this way...

It's the way the legal system works and common sense often takes a back seat.

My friend restored cars and had a small shop... he let his buddy store a car trailer in the back of the shop... the buddy said it's yours if anything ever happens and it did...

The legal stuff involved to get clear title was ridiculous and finally my friend did a lien sale for unpaid storage fees and got title...

He really didn't have a choice since it was licensed and titled.

It would seem unlicensed equipment would be less stringent...

Ultrarunner, I have possesion of the little tractor at my house along with all implements. I'm suppose to meet a camper guy at camp ground where the camper is this afternoon around 3. Hopefully we will be able to move forward after he gives us an appraisal.

The saga continues.......The judge that was drawn to hear this case back in March has decided to retire December 31st. Our case will not go back to court again until January 16th to an appointed judge.

I'm pretty well myphed over it all. The **** judge wont even grant permission to sell anything so we can do the right thing and pay off any of the debt. She is an elected prima-dona and I woulnt spit on her if she was on fire.

The workings for the legal system are the frustration of many... you are not alone.

Years ago I was buying a home and the owner passed away with a questionable will... the people he had left things to died 30 or more years ago... he had a single niece several States away and it was determined she was the heir.

For the better part of a year I was stopping by the home daily on my way to and from work... every time there was a break in I would do my best to secure it.

The short story is the Judge decided it had to go through probate and in the end a Lawyer bought it.

The sad thing is the niece got much less after legal fees and I could have saved myself a lot of work and aggravation...
