The county supervisor has more tractors on the road than anyone else. But, yes, we drive on the road. 7 miles from my house to borrow dad's, trailer 1/2 time, ride it 1/2 time.

Wow.. driving a spraying rig no less.. those can be some pretty big tractors.. makes you wonder what the driver of the car was doing that he couldn't see that he was approaching a big tractor... What if that had been a little motor cycle??? The driver of the motor cycle would be dead now, after the ford escort ran him over.......

Hmm.. i seem to remember reading somthing in a book about not driving faster than is permissible when taking visibility into account.. oh yeah.. it was a drivers license manual /forums/images/graemlins/confused.gif.. Guess that driver of the escort never read one of them... /forums/images/graemlins/shocked.gif

There is probably something in the DOT regulations about not hauling equipment on the street without proper lighting, or maybe this happened over the crest of a hill, or who knows....
we can sit here at our keyboards and Monday Morning Quarterback this to death and it won't matter a bit.

All true.. however.. none of it relieves liability from either party. If the tractor did not have proper sinage or lighting.. thent he tractor operator contributed tot he accident by creating an unsafe condition.. If it was a crest of a hill, then I still feel the driver was at fault. The law says you have to be in controll of your vehicle 100% of the time. If that meanse you have to slow down on hills and curves.. or when driving at night so as not to overdrive yourheadlamps.. then so be it. I've heard of a ticket for exceding a safe speed, or for going to fast for 'condition's, even though the person was not exceeding the posted speed limit. Obviously this means it is up to the driver to choose a speed at or under the posted speed limit that lets him drive safely, and maintain control of his vehicle, and not run into them because he is going to fast.. etc.

There may be other mitigating circumstances.. such as visual obstructions caused by the municipality or private owners partially blocking visibility of traffic ahead thru billboards, illegal sinage, parjed cars ont he row.. etc..
