Nope...
We can only apply for a tax refund on the fuel highway taxes...that is if you qualify as a bona fide agricultural user....not just an "off road" user. So guys like me out here are SOL. I use around ± 200 gallons a year for screwing around my property, but not for farming.

Huh?

That is wierd.

I get the feeling that your back up heating should be fuel oil. Yep, #2 fuel oil. Might be best to mix in some lubricity agents to keep the "furnace" pump in good order.

Home heating fuel oil and diesel fuel are the same thing here.
Surely the Cal.folks heating their homes with fuel oil/ home heating oil aren't going through this hoop (We can only apply for a tax refund on the fuel highway taxes...that is if you qualify as a bona fide agricultural user....not just an "off road"user.)

How many farmers and construction companies do you see filling up their tractors and equipment at the truck stops and service stations?

If they're not there they must be buying the non taxed diesel somewhere else.

I can think of no reason why you could not buy the no tax diesel from the same place they get it.

If nothing else buy what you need from one of the farmers or construction companies or have your drum filled there when they get their tank filled.

I'm sure the big users have their own tanks.
What I'm saying is I'm pretty sure they pay the going rate for the fuel, but they pay full price with all the taxes (whatever their deal is) and them get them refunded back at the end of the year. There's only one kind of diesel to buy and that's on road diesel. Unless I'm way off base, I'm pretty sure that's how California is doing it now.
Anybody in California buy the dyed off road diesel cheaper than on road diesel? I'd like to know.

1*Why not, there is no such thing as off road diesel fuel in California since the only choice is ULSD for both on and off road????
2*All the farmers and contractors outside of California throughout the rest of the USA are now using last years on-road 500ppm sulfur diesel fuel anyhow......

1*Even if there is only one formula you should be able to buy it un died taxed or died non taxed.
I'm not talking about 2 different formulas of diesel.
The point I'm making is from the tax stand point only.
2* So are you saying that when this supply is gone all of these folks will be charged tax on the fuel they use off road?

1*And the red diesel is in them.
2*Are you absolutely sure about this or are you assuming?
I'd be checking with some of these users and find out the real story.
At any rate it has to be the red diesel otherwise these folks could be running it in their on road vehicles right along with letting all of their friends and relatives fill their on road vehicles from their tanks.
3*I'd say it's more like one formula but 2 different colors and taxes.

He doesn't say it's cheaper than on road diesel in that statement. That's what I want to know. Can you buy off road diesel without paying the the taxes, or does he still have to write it off at the end of the year?
I'm asking...

This sucks; I mean it really really sucks.
Why should people that don't use fuel on the roads be forced into giving the Government and interest free loan year in and year out ??????
