The survey cost is on you. You are the one that wants the results of the survey and procured to have it done. Cut and dry to as who should have the burden of the cost. Trying to force an expense onto someone is a hostile act and will be viewed as such in a court.

The neighbor is going to play dumb on everything. You're the neighbor that is going to throw every technical aspect of this at them...but they will still play dumb. Technicals get a person nowhere.

Just get him to move the container, build a fence and move on. Keep the moral posturing and righteousness out of the dealings...

When we lived in town, our split entry home on 1/4 acre was next to a big house in the corner of the development. It turns out the 10 acres that made up the development had been owned by those folks in the big house and they had it developed. We were building our fence on the property line when the neighbor from the big house came out and said that we were way over on his property. I went in the house and got the survey (I had paid to get copy of survey on file from county) and showed him. He said he woudl be right back and went in his house and returned with a six pack of Pepsi. He offered me one and said nothing good comes from fighting with neighbors, lets work this out. After about an hour of studying the survey and measuring and looking at the markers in the street, he said, I was wrong, it appears you are right based on survey. We finished our fence and had good neighbors. It is not always possible to get along with neighbors, but it is certainly worth the effort to try.

When i looked for pins on my last house, found all but one. Neighbors fence cut slightly across the corner, and there was a pine tree about where the pin should be.

A thing about lawyers.

The judicial system rewards the person who engages the lawyer first.
So if you start with the lawyer, he HAS to respond.

But if he gets a lawyer too, then the two lawyers call each other up, strategize, and then they each bill their respective clients.
So you're both getting fooked at that point.

You will pay your own lawyer much more than it the cost for a container moving company to pick it up and crap it over onto his side.

You gave him notice, right? Did you say what will happen at the end of the period?
Rent will start on some date.
And you have the right to dispose of abandoned property.

As said, if he is operating a business I would check on it, that gives you some teeth in the matter.
It's good to know. But he can also turn you in - if you're not toeing the line. That path is no good.

But you gotta get that container off your property.

If you blow this up, just know that a bad neighbor devalues YOUR property.
If you cultivate a ad neighbor, your own actions devalue your own property.
It's trouble, like dry-rot in your wall, you don't want it. Stop it early, and monitor.
For example, go mark the property line and keep it marked.

If you can solve it amicably, a good neighbor is a significant asset to your property.

Lots of ways to look at this. Don't start with things you can't turn back from.

Pushing it over to his side seems about the most obvious if you can do that.
Note that a pickup cannot move a shipping container.
Give notice, and after the time period, move it onto his side.

This actually happened to a guy that I know.

There was a piece of land that joined his property. He went to the county PVA to find out who was the owner. They told him it was owned by a coal company.

He contacted the company to buy the land & they said they didn't know they owned it but they had no interest in it.

The company agreed to sign a quit claim to the property & they did. At that point the PVA transferred the deed to him.

Over the next 12 years or so he logged the property, cleared it & built a 40x60 shop on it. He also built another building on his original property.

All the while another property owner watched him doing this & even visiting him never mentioning that he believed he owned the same property.

The short of it is the 2nd property owner sued him taking the property he had improved, forced him to pay all of his attorneys fees & pay 3x the value of the timber & 3x damages for clearing the land.

IMO the entire thing was messed up from the beginning.

The attachment worked. I can open it. Poor guy, seems like after that length of time he could claim adverse possession.
