JD350 crawler (12,500#) on a 6K single axle tilt bed trailer.

Different circumstances though. I moved it about 900 feet from my drive back to my neighbors drive and didn't go over 10MPH.

Totally agree, it's not what you can "pull", it's what you can handle in an emergency maneuver. That said, the bottom line all depends on how far he is towing it, the terrain, and how fast he is going. If a kid or a deer runs out as he is going down a hill and around a curve and he hits the brakes...? (brakes???)

If he is just hauling it a few miles over good roads at low speed, that's okay. OTOH, if he is hauling it 50 miles over curvy, hilly two lane roads at 55-60 mph, lookout!

Ok, to transport this outfit it requires a new 3/4 ton diesel pick-up @ $50,000 new trailer @ $3,000 Already got what 15-20,000 in the tractor and FEL? So for a mere $70,000 this outfit can be moved 100 miles a year. That's around $7,000a mile and he hasn't bought fuel, insurance, and tires yet or paid personal property taxes. I'm afraid this would take the joy out of owning a toy tractor for me.

Other alternative. Do just what he is doing. Haul his tractor the 100 miles per year at 10 to 15MPH. Maybe get wild and kick it up to 20 MPH if no big hills. At the end of the year sit back and say "I saved $50,000 this year by utilizing equipment I already owned. $$$$

I try to be tactful and educate but if it gets heated .. oh well . Me and any party in question are big boys and we will get over any heated conflict that arises. I figure if I shy away and someone gets killed I'm just as culpable because I did not try and educate. Sorry that's just me. I chalk it right up there with anyone who doesn't say something or intervene when they are knowing someone is being hurt or abused is guilty of condoning bad behavior. 9 times out of 10 it goes well and I end up making a new friend. the 10th time .. well as I said oh well.

Whats with all this wishy washy "well if he is only going a few miles it's ok " perspective.

It's not ok . If your past legal tow capacities for your rig , your wrong. Point blank.

If you injure or hurt someone you will immediately be found at fault , you will also forfeit any chance you have for restitution through insurance co.

Dice it anyway you guys want .. but for me this issue is black and white .. no grays. If you are exceeding GVWR / GCWR and put your rig in Drive your flat out wrong.

- my comment , how much will you save when you are sued for everything you own, and spend time in Jail for wrongful Death should an accident occur resulting in a avoidable death. worth a mention a little child was killed here a number of weeks ago , hit by a car. Speed the car was traveling - 20 mph. - nuff said.

If I was over the speed limit and injure someone , I could be held libel. - and I would be wrong

If I knowingly exceed tow capacities and injure someone , I will be held libel - and I would be wrong.

CRIMINAL PENALTIES FOR OVERWEIGHT VEHICLES IN MASSACHUSETTS, NEW YORK AND RHODE ISLAND

The owner or operator of an overweight truck could also be charged with manslaughter in the second degree (CGS § 53a-56)). Under the statute, a person is guilty of manslaughter in the second degree when he recklessly causes the death of another person. The Penal Code defines the term “recklessly” as the “conscious disregard (of) a substantial and unjustifiable risk. . . of such nature and degree that disregarding it constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation” (CGS § 53a-3(13)). Second-degree is a Class C felony punishable by a term of imprisonment of up to 10 years, a fine up to $ 10,000, or both.

In the case of a fatality stemming from the operation of an overweight truck, the decision to prosecute and ultimate disposition of a case will depend on whether the reasonable person in the owner or operator's situation was aware or should have been aware of the degree of danger the vehicle's weight posed.

As is the case with Connecticut criminal law, the absence of specific statutes in Massachusetts, New York, and Rhode Island regarding the operation of overweight trucks does not preclude vehicle operators or owners from criminal prosecution. All three states have laws that punish criminal negligence in its various forms. The ancient legal doctrines of manslaughter and assault are codified in the penal codes of Massachusetts, New York and Rhode Island, and provide the structural basis for charges against owners and operators whose overweight trucks cause accidents that result in death or serious injury.

The penalties for manslaughter and assault in Massachusetts, New York, and Rhode Island vary considerably. Rhode Island specifically addresses deaths and injuries arising out of the reckless operation of motor vehicles (R. I. Gen. Laws ch. 31 ï½§ 31-27-1 et. seq. ), while Massachusetts and New York's laws have a more general application. Table IV illustrates:
