And that is why I dropped the Hazmat endorsement last renewal. Got tired of the hassle every time I renewed it. 30 question test every 6 years.:confused2:

Try being a pilot, take a written/oral exam and practical test every 12 months...

if you are showing horses for any reason other than pure pleasure; like for a trophy, prize money, etc; you technically are a commercial entity, and therefore subject to all DOT rules.

Please explain that line of logic. Private - not for hire - noncommercial can and probably would still apply.

Yep. I was driving thru alabama and their weight station was super busy.. had 4 dot's on either side of the raod ready to pull out. and they were.. had one pull out, pass me, and pull over a box truck in front of me..

so far I've never been challanged.. I also see lots of 3/4 and 1t trucks with various trailers pass em.. though non of them have decals or emblems of companies on them.. ie.. personal vehicles hauling private stuf.. ( or wanting to look that way ).

I go thru and let them decide. The two weigh stations on I-95 should know my truck by now. About 90% of the time I get sent to the scales instead of the bypass lane.

And as an example of what can happen, I give you this from SC. Any commercial vehicle over a 10K GVWR in FL is supposed to go thru. And if you have your private vehicle registered in a business name, you're stuck.

And as an example of what can happen, I give you this from SC. .

Something fishy with that link, he cites regulation 38-424 as evidence of what happened to him.

That particular reg has NOTHING to do with his ticket-

Here it is-

SC Code of Regulations 38-424. Safety Rules and Regulations.

The rules and regulations adopted by the United States Department of Transportation relating to safety of operation and to equipment (49 CFR Parts 382, 383, 385, 387, and 390-399 and amendments thereto), and the rules and regulations adopted by the United States Department of Transportation relating to hazardous materials (49 CFR Parts 171-180 and amendments thereto) shall apply to all motor carrier vehicles engaged in interstate commerce and intrastate commerce over the highways within the State of South Carolina, whether common carriers, contract carriers, exempt carriers, or private carriers, except where these aforementioned rules and regulations may conflict with South Carolina Law, provided that any rule or regulation which fixes the minimum age of vehicle drivers at 21 years is hereby changed insofar as South Carolina intrastate carriers are concerned to establish a minimum age of 18 years for vehicle drivers.

BTW I pass a SC weigh station every day at least twice and I've NEVER seen a pickup in one. IF what he said in the link is true then 98% of "pickup" drivers in a business are gonna be in big trouble, just don't see it happening in my daily travels.
Not yet anyway...

there's the hitch though.. if your vehicle is not comercial and of course privately titled.. you shouldn't have to go thru.

I can remember on 10 somewhere there is a station you pass and I can remember being in the lane where they do the pre-weighing I guess.. and I've always been directed to the bypass... but I expected that with a 3/4t and 16' trailer with a rusty tractor on the back.

If in a questionable position, you're 100% right. Take the scale and let them wave you on or bypass. Only takes a couple minutes as long as everything's legit.

From your quoted article, "If you operate a vehicle over 10,001 pounds Gross Vehicle Weitght Rating (GVWR) or Gross Combination Weight Rating (GWCR) in a COMMERCIAL BUSINESS, then you are considered to be a motor carrier. You do not have to haul freight to be considered a motor carrier. If you are in BUSINESS then you can be considered a private carrier and subject to the FMCSRs."

Which is not the same as a private - not for hire - non-commercial vehicle. As long as it's for personal use with no monies exchanged. Now, let's say you've got a 1 ton p/u and a wedge style fifth wheel with 2 or 3 vehicles loaded. Odds are you'll get stopped for blowing off a weigh / safety station. If all of the towed vehicles are titled to you, no problem. No titles or registration in your name? Now you are dealing in commercial traffic. You would need a CDL, medical card, triangles, fire ext., log book, U.S. DOT numbers (if out of home state) plus fuel and use stickers.

But you can be private -not for hire and Commercial. And that is what got him as far as I can tell.

Depends on the wording of the signs. Florida's say "ALL TRUCKS ENTER WEIGH STATION."

and if they meant that I'd expect everything from chevy S-10 and rangers to be going thru.. yet I've nver seen small and 1/2 ton vehicles going thru except an odd and rare landscaper pulling a traielr with a mower and weedeater on it, who must have actually had his act together..which goes back to my previous quandry.. selective enforcement of ambigous sinage or laws...
