Your example isn't quite right. The soda is food and is not taxed here anyway. The gas in a vehicle gas tank, I have to assume, would be seen as consumed where purchased, so no CA tax. If I filled jeep cans of gas and brought them back into CA, they would be subject to tax. Note, I would get credit for tax paid where the purchase was made and only be liable for the difference.

Though I agree with your contempt for the CA use tax, I believe there are many states, if not the majority, that have it setup the same way ... umm ... including the great state of Florida, per FL Dept. of Revenue. I know, I couldn't believe it when I learned of it here either :mad:

Not only that, but you probably paid sales tax on those items in the state you bought them in, so that satisfies the tax being paid. Now, what about those states where there is no sales tax...are there any?

It's just a wild guess (already know the answer) but isn't gas taxed at the pump in FL? Now the soda thing! I'm pretty sure they would throw that in as a freebie :p

Now if you drove from CA to FL and back for a soda? That could have some repercussions best left untold :D

Seriously though! Doesn't FL have a Use tax?

OOPS. I guess I answered my own question...

Use Tax and Consumption

Use tax complements and is applied in the same manner as sales tax. The use tax rate and sales tax rate are the same, including discretionary sales surtax, if applicable. Use tax is due on purchases made out of state and brought into Florida within 6 months of the purchase date. Also, if you purchase a product tax-exempt that you plan to sell at retail, but end up using it at your place of business, the "use" of the product is subject to tax. If you purchase materials that are "consumed" in a manufacturing process to create your end product but are not part of the end product, those materials are subject to tax.
The "use" component of the sales and use tax provides uniform taxation on items that are purchased outside Florida but are used or stored in the state. If the item brought into Florida is subject to tax, a credit for lawfully imposed taxes paid to another state, a U.S. territory, or the District of Columbia is permitted. Credit is not given for taxes paid to another country.

This is a wonderful forum for getting advice on tractors, implements, etc. But a tax forum its not. You need to get tax advice from someone in the tax business.

Government is a ripoff. By some accounts, Ron Paul of Texas being one, local, state, and federal taxes consume half of what we produce. The people we elect for the most part are liars, charlatans, and thieves who prey off of our envy and greed. We can go to jail for cheating them. They get reelected when they cheat us.

We have also have Elected Looters in Mississippi that think the answer all their problems is more tax money for them to waste . I am also an unreconstructed rebel.

Quite a bit of food items here doesn't qualify as grocery... but rather as luxory.

In your example, I wasn't aware that you got credit for the tax paid out of state. ( I was aware in florida ).. that does make it a bit different.

His original example didn't state that california gave you credit for taxes paid in another state.

And yes.. florida has a use tax. Our company operates a sand mine and a lime rock mine. Materials mined from there that are incorporated into a road project, are 'use' taxed to our company.
