Your example isn't quite right. The soda is food and is not taxed here anyway. The gas in a vehicle gas tank, I have to assume, would be seen as consumed where purchased, so no CA tax. If I filled jeep cans of gas and brought them back into CA, they would be subject to tax. Note, I would get credit for tax paid where the purchase was made and only be liable for the difference.
Though I agree with your contempt for the CA use tax, I believe there are many states, if not the majority, that have it setup the same way ... umm ... including the great state of Florida, per FL Dept. of Revenue. I know, I couldn't believe it when I learned of it here either
