1* I live along a state high way.
The state has a 35 foot right of way from the center of the road and does the ditch mowing but I really don't know what rights I have between the ditch and the rest of the 35 feet over onto my property nor do I know what obligations the state has to maintain the ditch or the balance of the right a away.

ok, I would guess that you cannot put anything there that you dont mind them removing whenever they feel like it, otherwise it is yours to do with as you see fit (within legal boundaries, or course)

probably none, however they probably try to keep the ditch and its bank clear so that water can flow wo/blockage.

I guess then what are the legal boundaries becomes the question.

They aren't the greatest at maintaining the ditch so I've been doing that with my BX23 but am I really allowed to do that I don't know.

It is common practice to mow the roadsides here in Illinois. The state mows along major highways but the country roads is up to the farmer or land owner. If you were to drive around our area you would see alot of this going on.

I talked to my land lord about the problem with this guy and he informed me that the house is a rental home and he said he believed the guy had just moved in last winter. He suggested if I have more problems with him that we get in touch with the owner of the house. I am just glad I don't live near this guy I just farm near him. My land lord also told me to do whatever I needed to do to get things done around there including working late hours if I chose to. I am hoping to see my deputy friend some time this weekend.

Deere - this chucklehead will hopefully end up taking himself out of the equation. As others have said, kudos to you for your handling of the matter

update

My landlord came down from Chicago for the July 4th weekend and to stay for a few days in his weekend home. He called me 1st thing this morning and asked me when the last time I had been by the field. I told him it had been about a week. He told me that someone had driven all over the field doing donuts and tearing up the beans and wanted to know when I could be over to look at it. We met this afternoon and the tracks led to the trouble makers house my landlord was furious. I told him about my little run in with the neighbor. He was on the phone with the home owner and asked him to come over and look at the damage. We talked to the home owner and he explained that other neighbors had complained about his tenant and this was the final straw he was going to ask him to move out. I was talking with the owner of the house and it turns out the man farming his land is going to retire at the end of this season so we talked about me renting it for next year. This has turned out to be a great day. I think we are done with a bad neighbor and I may have picked up some more land in the process. We are going to get together in a couple of weeks to discuss the details.
