Government already had the power to take private land for public use such as the airport runway or highway you mention. What this Court decision did was to expand the scope of eminate domain to mean that private land could be taken from one party and used by another private party for the "public good", i.e. job creation and increased tax revenue.

A developer in my town has been trying to buy the local Dairy Queen property because it borders an amusement park he is building. The owners, realizing that an amusement park will be good for their business, will not sell. With this Court decision, the delevoper can now argue that he has a legal right to the property because he will employ more people and pay higher wages, making it in the best interests of our community. As screwed up as our local government is, he'll win too.

This could possibly be the next Supreme Court ruling if the Dairy Queen operator starts to fight back. Problem is that the entire political system is run by lawyers, for lawyers, and they all pick the pockets of the entire population. I don't care if they are red or blue state politicians, they all suck the life out of individuals and have no other reason than for personal gain and greed. The land of the free and the home of the brave is now nothing more than a paper puppet with the politicians pulling the strings. ..... /forums/images/graemlins/frown.gif

yeah but what Don is saying is that the land bordering this highway will belong to a private company ... foreign one at that! So they will control any development along that track.

Your right, although the railroads have had this deal for over 150 years.

Yes, but most railroad right of ways are about 100 feet in width, not 1,200 feet like the TTC-35.

These people in New London have been fighting this for years. You have to remember, at first it was fro the city itself to expand. Along the way, the city gave it over to private investors/developers and this is where these 15 homes have beat five previous court appearances/lawsuits, locally. The supreme court turned against these people today.. Sad, sad day for all
