Does anyone have any advice in what you should look for in a gas lease. In our area they are drilling quite a few new gas wells and I have had several companies trying to lease my land, most of the terms of the contract are nearly the same. I would appreciate any advice as many of the terms in the contract are not easy to understand.

In paragraph 1, 2, & 3, they give you money, in paragraph 4,5, & 6, they take it away, and it 7 & 8, they deny that you have any rights left. It is like selling your land, but you are still responsible for the land and the taxes. The offer would have to be very attractive to want to get into bed with these people. They have a building full of lawyers that write the contracts and they tie you up every way that they can. I would be more inclined to sell the land to them than to give them drilling rights. Once you sign the papers, usually they own all the rights to everything under the ground. It is a very dangerous thing to do if you are not well versed in these type of deals. They are definitely one sided and not on your side either!!!!

I'll agree with Junkman on this topic. If you own any amount of land at all, have a lawyer review the lease and translate it to "English." I signed one 5 years ago, but in my case, the company could not use my land for drilling, etc., due to the small amount that I own. If you own much more than 5 acres, you probably will be giving the right to drill on your property.

I know someone who ran into the same thing. Someone came to his door trying to work a lease deal. Instead of signing, he told the guy to bug off. (This is how he found out he might be sitting on gas).

So he went and contacted a gas company and told them he had gas on his place and if they worked the right deal with him, they could drill. He got a lot better deal working it from that angle. BTW: I don't think this guy could tell you his networth to the nearest million.

What is "usual" depends on what part of the country you are in. The rules and regulations governing drilling vary from state to state. As a general rule, never sign a lease agreement as presented by the energy company. It will be formatted to their benefit - not yours and they expect you to negotiate. Never sign an open ended lease. Always have a term, 3 to 5 years, whereby if they don't drill the mineral rights revert to you. The owners royalty is usually in the region of 12-1/2% to 15% but can be negotiated upwards, depends on how desperate they are to drill. Contrary to some advice here, never, ever sell the land. That's how some oil companies became huge in real estate, buying mineral rights and land from dirt poor farmers for next to nothing back in the early part of last century. Get everything you want from them if they drill and produce in the original agreement - loss of land use, damages to fences and property, how they will run the pipeline, roads etc., etc., in the original agreement. If you are unsure about all this, get in touch with a lawyer familiar with leasing arrangements. He will cost you money but he should also save you from some expensive mistakes that will be very difficult if not impossible to fix later on.

I did work a timber deal a few years ago. One thing you don't
do as a timber seller is sell to the guy who sends you a letter or
knocks on your door. In my case I had a closed bid auction
run off the tail gate of my truck.

The winner then signed a contract about what he bought, what
I sold, what he could and could not do. If he had not taken the
trees in two years then he lost em and I kept the money. I
heard of someone where this actually happened.

Search your state web sites they might have some info for
you. NC certainly did for timber sales.

Also search Tractor By Net for discussions on this topic. Believe
it or not this topic has come up before and there was quite a
bit of info in the discussion.

Ernemat, about 5 years ago I lease my land out for gas for 2 years. Got enough money to put up about a mile of new fence. I had a stipulations. I forget the exact acreage they need for one square unit for each well head (maybe about 600ac). Got paid, lease expired never heard from them again. /forums/images/graemlins/grin.gif

About 20 years ago Grandpa lease his land out, had a pumping oil well got a couple of K. When plugging his well an explosion killed two workers and local vol. F. D. members sustained burns. Most people around here do lease their land when the oil and gas people come around about every 10 years or so.
