Never attribute to malice that which can be adequately explained by incompetence. Sounds as if the author of the letter does not know how to write clearly.

If you want to be certain, contact the County Register of Deeds' Office in the county where the land is located, give them the legal description of your land, and they can tell you if any such lease was recorded. If it was, report it to the sheriff.

C'mon folks. . . A lease agreement is written in legal language that states you have signed the agreement. When you get it signed and notarized, it makes sense at that point. This is no scam, it's common language on this type of document. The fact that the lease agreement was accompanied by a request letter means it is just SOP. Not having the proper info on Chad's father may be nothing more than the deed records showing him as the the exclusive owner of the property. If it was deeded to him when he was single, that is completely normal. You'd see the same thing if you looked at my property and house in the recorded deed. The folks who want the lease will just do a records search and create documents based on deeds. They expect changes before the agreements are finalized.

Having said all of that, Chad is wise to hold off on signing unless this is what he and his father want to do. He should also ensure that the document is accurate and contains info on his father's spouse so she can also sign. It's not anything to get excited about, but could be an indication that there is some money to made for them with their mineral rights.

You overlook the stated fact that the sender claims the lease WAS executed Nov 1.

It depends on whether the cover letter, or the lease agreement, claims the lease WAS signed by the OP. Jinman is most likely correct. BUT the cover letter was poorly written if it does not clearly say in so many words "here is the deal we want you to sign."

If it was deeded to him when he was single.
My Grandma, my dads Mom. Bought out all the property on both sides of the street. The deed/deeds were put in my dads name before his mom died.

I remember going to the courthouse with my mom, dad and Grandma when I was 7 to get things changed over. So he wasn't single when the deeds were put in his name.

Actually I think my mom's name is on the deed as well. I'm gonna have to ask her.

It makes my head spin going through all this legal stuff and reading legal papers. :confused2: That emoticon is how I look when reading through legal papers.

Me and my dad are gonna run the papers by the courthouse tomorrow and see what we can find out about this.

Another thing. There actually drilling for oil about 10 miles from here and have started drilling another oil well around 25 miles away. So I don't know what to think.

I guess we'll find out for sure tomorrow.

It seems the only way to protect your own land nowadays is for you to take out your own mineral rights on it before anybody else does. Next thing they will want you to shift your house so they can start exploratory drilling.

No, I didn't overlook anything. That date can be lined through and changed to the actual execution date with the signees initials. Now, since I don't have the actual document, I can't be certain, but I can say I've read exactly this kind of language on lots of documents. It's not uncommon and should not automatically say, "Scam!"

Chad, I just want you to not assume this is someone trying to cheat you. My advice is simply to withhold judgement until you investigate further. It does no good to put a chip on your shoulder. If it is trickery, you'll know soon enough. Always be skeptical, but not necessarily judgmental. That's my advice.:)

with the side drilling for gas and oil and the fracking it is hard to know about your mineral rights. I live right in the middle of it I have signed an agreement for the gas under my property, strange thing is the drilling had already been done. So either I sign and get paid or do not sign and do not get paid. either way the gas under my property is pumped out.
