Sigh......Yanmar did NOT win a suit against Wallace. Where do you come up with this? Wallace signed a consent decree, meaning he chose to settle and not to let it go to trial. Thus Wallace was NOT found to be infringing on Yanmar's trademark. He voluntarily agreed to say so and to cease any involvement with the grey market Yanmars.

That sounds like a win to me.

The vast majority of what has been posted in this thread is literally inaccurate from a purely legal perspective. Might a settlement portend a trend? Maybe. Does it guarantee a win in a courtroom? Absolutely not. None the links listed state it is illegal to import grey market YANMARS. Kubota agricultural tractors under 50 HP, perhaps. Not Yanmars.

The settlement does NOT require the former Wallace dealers to stop. Many, if not most, of them are still in business.

I love the post that acknowledges tossing out a "headline" just to grab attention, then calls for a "calm, dignified and ethical discussion"

The word black market fit the question I was asking. If the info i was reading was correct that would make it a black market. Those were just a few links google it. I'm sorry if you think this post hurts your business. You could easily turn it into a post that supports the grey market if you were to post documentation, cite laws ect. Thats what i was looking for. It seems when it comes to subjects like these all you get is hearsay. Not all hearsay there are some first hand accounts.
