Now as far as taxes and the fellow who makes his own biodiesel goes, were the feds checking race cars for the fuel, or checking all the racer's tow vehicles? If I remember correctly, it should not have made any difference as automotive fuel doesn't get dyed, and the home fuel isn't dyed either. It's the stuff that goes into your home heating systems and dedicated off road AG equipment that gets the dye added.
Exactly.. the fuel was dyed and prolly mixed with his own fuel and thus illegal for road use. You own, homemade, biofuel is NOT illegal for road use.

Technically I guess it was "stealing"..

However the MOST that should have been done was a written warning as a first offence.

Side note, I guess that all other crime is under control in DeKalb county and the police have nothing more important to do.

Reading this http://abcnews.go.com/Business/ga-man-arrested-charging-electric-car-local-middle/story?id=21098590, it sounds like the cop was a bit of a dick because the car owner dared to question why the cop was inside his car rooting around. This quote was from the report, holy typos Batman!

"
Kamooneh said a Chamblee policeman was inside his car, with one foot outside.
"I wasn't sure what was going on. I asked him why he was in my car. He was very uninterested in answering my question," Kamooneh said. "I asked him at least one more time."
Kamooneh said he noticed the car was unplugged and the charger was on the ground. After providing his driver's license and asking for the officer's information, he said he was later told that his car was abandoned on public property.
According to the Chamblee police report, the police officer wrote, "I asked him why his vehicle was plugged into the power at the school. He told me that was an excepted [sic] practice and that I was making to [sic] much of it. I asked him if he has [sic] asked the Dekalb County school system if he could take the power. He told me that I did not ask if my patrol car can dirty the air -- did you? He says 'No you did not'." "

You guys might want to consider that the police informed the school and the SCHOOL pressed charges. They did say they talked to the school PRIOR to issuing the arrest.

Dunno.. you would think it would go under 'civil', but still..

I live in Atlanta until I retire to the ranch in Crestview. Chamblee police actually manage the small stretch of I-285 that passes through their jurisdiction which is a huge revenue generator. They are "sticklers" and will write you a ticket for 4MPH over the limit so I'm not surprised they followed up. That said you could look at it as no different than taking a garden hose and putting it in a county vehicle and sucking out some gas to put it in his tank. He was just unlucky that he didn't get a full "tank" before he got caught.

You could also look at it as someone climbing your fence and running an extension cord to your outdoor outlet and using your power without asking. Doesn't really matter how much they took and you might not even notice it until you get the next bill and it has gone up $150 more than usual. If they don't establish precedent then 1000 cars will expect to plug in for free county power. I believe Atlanta leads the nation in sales of Nissan Leaf cars so nip it in the bud.

After reading the report, I tend to think this guy was an @hole and most likely HAD been warned about using the power, especially since he wasnt even from that district. He prolly pissed someone off and thus the phone call to the police.

I see this happening more and more as electric cars become more prevalent. People will think that they can plug in anywhere they want and just get away with it. However, now that they've got the publicity they obviously wanted the charges should be dropped.

Including your relatives that may get an all electric car, comes over to visit you and wants to plug in while having dinner with you. Now what are Lu going to tell your relative? No, they can't do that and will need to have their car towed home if they run out of juice on the way back? This is going to become interesting.

Need to come up with a sign...what would it say? Charge your car before coming over? This is a good one for Dear Abby...

As for opening the car and picking up the mail on the floor, the officer already had proof the vehicle was an active crime scene, was being filled with stolen property; and didn't require a warrant to search it.

No. For so many reasons, no.

If you read the story, you'll see that didn't happen.

Ford said he sought the arrest warrant after determining that school officials hadn't given Kamooneh permission to plug in his car. Ford said Chamblee Police did so without asking school officials if they wanted to prosecute the alleged theft of electricity. A DeKalb Schools spokesman did not respond to a request for comment.
