Following this thread demonstrates the importance of having clearly defined property boundaries/markers etc.
In my area the gov't has undertaken to re-define all properties and it is simply amazing the discrepancies that have been found.
Property lines in middle of houses, roads that were never ceded to gov't , driveways on neighbor's property etc etc.
Heck there are even houses that are 1/2 in Canada and 1/2 in the USA.

Some oldtimers sold land 'from the big oak to the big rock' etc etc and nobody ever registered those deeds.
In fact I had a property that I leased from govt and then purchased at a later date (all surveyed by them).
When I later sold it I discovered that the deeds had never been registered (bad gov't) and it cost me some $$'s to do so.
Bad bad me, and worst yet bad notary as he should have known better, that being his trade.
30 years back that would have cost a pittance but later on it was costly as searching all deeds etc added up to $$'s.
Naturally the notary is never at fault as I should have known better. Yeah!.

(In Quebec we have notaries while other areas have title attys.)

10+ years ago, we had boundary dispute with neighbor (ended up we were right, they did drill their water well on our property). After thousands spent on attorneys, we decided to grant a temporary easement for a price. Fast forward, the husband has died, the widow is selling off the land that is next to us, first the piece without well on our property. New neighbor was "ready" to start building May1, but only thing they have done is let the weeds grow (told farmer that had been farming it to not farm it, they were going to take care of it)... they have test holes for septic (99% sure they have to do pressure mound or similar system), but no well drillers yet (have to have septic and well approved before building permit will be approved). I was sure they were going to drill on our property because of where the farmer stopped planting on our side (he has lots of trouble with boundary lines, the wheat ended over a 100feet from line) and we were gone for 8 days about when they should have drilled. We were able to catch them at the property line in early July and make sure they knew where the line was and start things off right. Seems to be going fine (they still haven't drilled, but were out once earlier this week for an hour or so walking around in the weeds..

I am fierce about my property and don't take kindly to folks thinking they can do whatever they want on my property without any discussion or permission. When we had the dispute earlier, we went down to the county to make sure our interests were protected. The engineer had took everything our bad neighbor told him as fact (like we signed an easement to put a cul de sac on our property and the surveys were wrong and there was a road and utilities easement on our property, there is neither).

I wish I had had more time and money to fight harder back then, but we were paycheck to paycheck (no debt, no mortgages, no car payments, nothing). We did not want a bunch of debt to prove what was ours.

I never understand trolls. That bored? I can't wait for the climax of this drama. Reeeaaallllyyyy hope the OP ends up with her property after what she has cost him. What? Is she a relative of the governor or something?

Nothing exciting to report. The neighbor lady's court appointed attorney's assistant ask the judge if it would be OK if her client could pay the courts, instead of directly to us. I think the reason behind this, it cost almost $7.00 to send the money order certified mail.
So far she has paid us $765.00, she still owes us $2,441.66.
Next court date November 17.
I wonder how long the court system is going to let the neighbor lady waste the tax payer's money?:mad:

HOLY AGGRAVATING, The judicial system is clearly broken. You have much more restraint than myself. I would have long since taken maters into my own hands in various ways, especially after the initial involvement of police. When asked why i acted the way I did my answer would be " I tried it your way and you did not resolve the issue, which is a matter of safety and well being."

Trust me Kid, it is all I can do to keep my mouth shut in court.
I worked on the water front all my life. I have no problem taking matters into my own hands.;)

Wow, That is about as unsatisfying as it gets. I hope they atleast setup a payment schedule or something to move things along before november!

No offense, but it sounds like you need a new lawyer. One that will raise holy **** in court to the judge for the lack of progress, the lack payment, the lack of respect for the court, and specifically the lack of the bit... uh person not paying what is owed you.

The last time I was in court. I was talking to the deputy prosecutor. I ask him if I was going to live long enough to ever get my money. He replied "I don't know". He said the judges are very lenient, as long as she makes an effort to pay. They are fine with it. I'll bet 99.9% of the members here don't pay their bills like the neighbor does!
