No, everyone does not have to have a CDL. I've run into this on more than one occasion, with and without my horse trailer. This is part of the problem why I have been stopped for blowing off a scale, lectured for not having DOT numbers, ticketed for no medical card and HOS violations. DOT rules do not apply in every situation, even if the CVEU of NYS says so. You might very well be the guy who wrote me in Sept. 2017 for no medical card and HOS violation because of no log. That joker did not look at the back of my license (front says A, back says A - noncommercial) or listen when I kept repeating, I am NOT commercial. Did waste a bunch of my time roadside though.
That drives truckers crazy; weight is weight, no matter who you are hauling it for. My uncle ran a short haul company trucking from Boston to Augusta ME, and that was an oft heard comment. The law is the law though, and you are merely abiding by it.

Like I said man, unless there is a exemption.

If you drive your 27,000 GVWR truck with 12,000 lb GVWR trailer down the road for personal use, you still need the correct license.

Just to add to the issues. My understanding is that here in Oklahoma if you have any advertising or a business name on the truck, trailor, or equipment being hauled, your supposed to have a commercial tag. Not necessarily a CDL drivers license, seems that depends on other issues.
What makes it really frustrating is it seems to be rarely enforced.

If you have commercial plates on a pickup truck you have to stop at the scale house. I can have the same truck same trailer same load and drive right by with regular plates

The scale houses here in California have large signs the say NO PICKUPS

Pickups have commercial plates unless a permanently attached camper.

Not in NH, regular, commercial,farm, Agricultural ,Apportioned ,etc ... scale house sign says all commercial vehicles and buses

However, all California weigh stations have signs stating: "No Pickups." So, if a vehicle meet the definition of pickup in CVC Section 471, it is not required to stop at the scales because of the signs stating: "No Pickups."

It gets complicated in that a pickup is no longer a pickup if it has a flatbed or utility bed...

My 3/4 van is commercial and has only 2 seats... my buddy has the same van with 4 seats and has car tags and hauls the same things I do but pays no weight fees... my 1985 Chevrolet Van has $240 tag fees because it is Commercial...

I swear one day I am going to buy an old motor home and gut the inside...

You can rent a box truck 24 foot GVWR of 25,999 lbs, Do they stop at the weigh stations maybe a 50/50 chance:)

State to state they change things, but the one thing that is common is the federal regs out of the 49 CFR. They are the same across Canada to Mexico. Your individual state can go stricter I guess though!

If your passing through NY and have a question, I can give you the answer, every else, I can give a pretty good answer if it’s a federal reg matter.

I'd move up there but I'm not a fan of cabin fever. The lake attraction is good until black fly season starts. The family loves life up there but when the biggest employer is ICE and NYS :eek: Oh wait, you guys got chickens, apples, Nova bus and Arnie's too. :p
