Is it illegal

   / Is it illegal #11
The reason the transfer tanks are legal is because they are metal, and don't create a static charge while running down the road. Plastic tanks do. Again this is strictly a technical issue and the likelyhood of actually having an ignition is tiny. But that is the law, and the fueling station 'should' be refusing to serve you. Whether the teen behind the counter knows any different is another story.

Got to call you on that one -
I think the DOT limit is 119 gallons for non-bulk containers, and no limit on total gallons.
Diesel
Less Than 119 Gallons Non-Bulk
Diesel fuel is exempt from the hazardous materials
regulations if packaged in non-bulk (less than 119
gallons each) containers. When carried in non-bulk
containers, there is no limit on total gallons carried at
any one time.

9*The limit you can haul is 120 gallons no matter how many or how few containers you use.
Useing 2 55 gallon drums with a 110 gallon total keeps you legal.

!

/edit - diesel is treated as non-flammable, but combustible so there are different regs than gas.

truck tanks are poly, and attached to frame via straps.

seems they's be just as suceptable to static as a poly tank in the bed, secured by strapping.. no?

not being argumentative.. just pointing out what looks like a logical / legal loophole?

I agree, it doen't make much sense, but that is the reason. After all, all vehicles are isolated from grounding through their tires.... soooo....

yep.. an odd one. undeslung poly tank strapped in.. fine. poly tank in bed, strapped in.. illegal and dangerous.

that's what happens when safety rules are made by lawyers, politicians, comittee and bean counters.. and not engineers.. or scientists..

**** I just found out it was illegal for me to carry my 5 gallon gas from the gas station to my house in the back seat of my truck.

try to get a bottled gas seller to put a tank in your backseat or trunk without an anti roll carrier.. :)

I don't know what you are referring to as "bottled gas" but I (as well as the wife) take our 20lb propane tanks to the propane place to have them refilled and the guy there always watches me load them into the trunk, he will even load them for the wife. And this isn't a gas station, it is an actual propane distributor, coincidentally the same place that brings the truck to my house to fill my tank. (it's actually nice because if I walk in to pay my bill at the same time they will sometimes fill my 20lb tank for free :))

I have also replaced the tank for my kegerator at airgas and they had no problem with me transporting it in my trunk (granted that is only c02). For my bigger tanks I always take the truck.

Therein lies the difference!

Gasoline is a FLAMMABLE liquid, meaning it emits fumes at STP (standard temperature and pressure) or thereabouts
Fumes from flammable liquids are susceptible to ignition from a spark such as that that may be found when you or a pump handle (or something) "ground" an otherwise ungrounded tank in a truck bed.

Diesel is a COMBUSTIBLE liquid- it does not fume at STP, and thus is not susceptible to ignition from a static spark.

Unfortunately, blanket safety labeling at your average "gas station" does not take this difference into account, as they err on the side of CYA.

Even DOT labeling rules now do this, as mixed loads of gasoline and diesel can now be placarded as "1203" for gasoline, even if the bulk of the load is diesel (1993).
