You can't be serious. So people have a right to be impaired in a work place? Thats idiotic.

Allow me to rephrase: “You can’t be serious. So your employer has a right to fire you because a test shows you had a beer 2 weeks ago at dinner? That’s idiotic. “

Not sure how you reached the conclusion that PuffyC was saying people should be impaired or drunk at work.

Employers using testing that only shows you were impaired at some unknown time within the last month...even if on your own “FREE” time (supposedly), is overreaching by any standard.

Who said anything about it being OK to be impaired at work? My point is that what you do on your own time is your business, not that of your employer. Or maybe you think drug tests only detect what you’re under the influence of at the time of the test, and that the tests are only done during work hours? You can be stone sober on Monday and still fail a test for something you did Saturday night.

Interesting. I wonder if employers test for marijuana anymore given it’s increasing legality. Seems if it’s legal then if you partook on Saturday (like alcohol) it would be ok.

If it’s an illegal drug then I suppose it’s similar to other illegal stuff. You can’t expect employers to hire you if you rob gas stations - even if it’s on your own time.

I don't touch ANY drugs, but the way I understand it, they linger in the body and can be detected in tests after use. So if I guy wants to hit the bong Friday night, it would show up Mondays test. At least that's the way I understand it.
What deeply confuses me is weed is legal in many states. I guess they are saying a perfectly legal drug, like weed is OK to use, but not if it gets picked up in a random test for an operator/driver?
I'm in Citydudes' camp. I don't want any alcohol abusers or drug users working for me, but it is strange that weed is legal in many states, yet gets a CDL pulled if found in holders urine.

So all of us drivers and operators get tested for weed and other substances and states legalize marijuana :unsure:
that's become a real problem for pro sports. Some states it's legal, some not.

i read a sports reporter recently went into LA Lakers? BB locker room after big game and couldn't see across the room for the weed smoke.

Govt can not legislate morality.....i guess they try but to repeat a great line in Mississippi Burning....

This is a dry county and we got the drunks to prove it.

Yeah, I suspect that’s just old people clinging to the idea that cannabis is evil and anybody who smokes weed must be a whacked out psychopath who can’t be trusted (full disclosure: I’m old). So you‘re a raging alcoholic and want to fly an airplane full of people? No problem, just lay off the booze 12 hours before wheels up. Your doctor prescribes cannabis so you can sleep better at night and awake more rested the next day? Oh no, you’re far too much of a risk to do anything like drive a delivery van. The world doesn’t always make sense.

I have zero problem with that and agree completely. That’s not how most drug testing works however. My problem is the idea that an employer can essentially search your private life even when they don’t have any reason to believe you might be a drug user. That’s really no different than them saying they have the right to randomly come search your home for illegal guns because if you do, you may decide to bring one to work someday and that would create an unsafe work environment. Safety first after all.

The problem is that a positive test does not always mean the person was impaired at the time of the test.


Also, a poppy seed bagel or muffin can cause a positive test.

FAA alcohol rule is 8 hours!
