In some states that A parent or anyone else besides the courts can not give up the rights of a child. So if a child get hurt and even if a waiver is signed for the child, the waiver is not valid becuase the child rights can not be signed away.

They need to find a riding area other than your property.

I would strictly disallow it -- even with his "letter", that would cover ordinary negligence --

-- a court could see a kid dead as a result of "gross negligence", and no matter what you did, you'd be screwed --

-- also, the lot is considered an attractive nuisance, and that further makes you responsible to idiot-proof it.

i would never, ever allow it -- you think life is bad, but it ain't ever as bad as being stuck in a lawsuit.

The seller cleared a 6' wide path with a dozer all the way to the back. After 3 years, even that is partly closed. I don't know what's in the back of my property. The more I think about it, the less comfortable I become. What if .....? By the way, I don't live on the property. Please advise. If I can be cleared of any liability, I want to let his grandchildren ride their bikes there. They cannot hurt dirt, right? That's my thinking. Am I too naive?

One more thing. I put a concrete driveway that connects the property to the state road. Basically, the property is accessible to anyone who wants to. I have yet to put posts, chain, and the "Do Not Enter" sign. The property is 40 acres and surrounded by 1-10 acre lots on 3 sides, many of which are lived in. So it's not quite in the middle of nowhere. Thanks.

On our property, the ONLY two ATVs covered are our own insured ones, anyone elses are NOT. Same goes for our horses, only ours are covered specifically.

You have to understand a few things. Anything anyone signs is worth NOTHING period. Anyone can sue for anything at any time for any amount.

It's the insurance companies that will fight you like a dog with a bone,because they get paid by the hour from the insurance company and they have ti justify their jobs. If they lose so what they insurance company has lost NOTHING, because they had to pay the lawyers on staff any way. If they win, it's like the Nigerian PHISHING, scams on the net. If they file 10,000 law suits and only one percent pay off, it's found money.
