So it would be better to just run them over, thus improve the gene pool? :scratchchin: Most states in the U.S. still honor the principle of contributory negligence in tort law. In its purest form, any contributory negligence at all by the injured party is a complete bar to recovering damages. Only a few states still follow that rule. Most now follow a modified version, allowing recovery based on the proportionate share of negligence.

As another poster has said, it's not so that the pedestrian always has the right of way. However, he/she would in a crosswalk!
