Did you see the house that the guy with the saw has? Maybe he should be focusing his efforts on fixing up his own place instead of tearing down some else's. It is obvious that the garage was there for a while and also the retaining wall didn't just show up either. It just seems a bad situation was made much worse by mr. saw guy. I bet he is just lovely to live next to too. :confused2:

Seriously, that pic that shows his own half-finished shack in the background.... like c'mon man, you're complaining about them? :laughing:

As for my friend that chose to demolish his shop. How can such a talented man, that built his own house and shop, from digging the hole to the roof, make such a stupid blunder to build on anothers property, never mind the setback requirments?

When we bought our property, the land survey showed the west end property boundary angled from the NW corner which was approximately on the survey boundary to over 100 feet inward on the SW boundary. We contacted the owner (who lived out of state) and she said just put it per the survey, so we installed the new fence on the line after hiring a dozer to clear the old fence and trees.
On the SE corner, the survey showed my neighbors little 1/2 acre parcel' fence to be a couple feet onto my side. When I put up my fence, we had a discussion and I said I would fence it so he had room to run his lawnmower between his shop building and my fence. It was only about 100 feet long x 2 feet wide, so what the heck, it promoted a good neighbor relationship.

A house and driveway near me was apparently built on the line. The map used to show the line going through the house. Now it goes around the house and driveway. The neighbors must have worked it out without saws.

State highway in Washington, SR 195, was realloighned back in the 40s. guy had a nice (for them days) 2 story house that would have been partially on the ROW. He refusded to sell, or move. They took the ROW vie eminent comain, cut off tha portion of the house that was now on the ROW and boaded up the opening. It stayed gthat way up into about the 70s or 80s.

Adverse possession isn't as easy as some make it sound; it has to be done for a specified period of time, after the owner has notified you to stop. Just because you've been using a path across your neighbor's land for the last 20 years doesn't mean that he can't tell you after 20 years and a day that you can't use his path anymore.

If you read the article you will see that the garage wasn't the start of the dispute, and merely a byproduct of the survey which ensued after the line dispute.

Not quite right in this state. The rule is, IIRC 7 years use that the "owner new, or should have known about it" and did nothing. Safety sake on letting a neighbor use part of your land is to have it in writing and renewed periodically (depending on the period in your state).and certified

Most states seem to have the "knew or should have known) clause in their statute.

Thanks. It still doesn't really make sense to me. Maybe, My mind is programmed to think of front wheel alignment or aligning an old TV set or receiver.

Around here, changing to using very accurate gps creates some issues too. A well established lot line from the 50's or before may not be as accurate as people thought. When property is sold and surveyed, there may be discrepancies. We will see those on a plat map and they call them "gaps". A land owner can get a lawyer to go through the courts to verify the gap belongs to them. My dad had to do this.
