My wife and mother in law were next to someone who got tboned (not very hard) the other day. They stopped and told the cop what they saw. He thanked them profusely for having stopped and being willing to give a statement. He said that that makes his life MUCH easier when there is someone to verify the drivers stories.

Saddest part is how you as a witness may suffer. I witnessed a fatal accident and attorney's made sure I paid for it. I felt bad for the one "witness" that didn't see the accident, but the attorney's called him in to court as a witness. He had to take the day off work. We show up in the morning and are told that the date had been changed. When I went back home, I received a next day parcel letting me know of the postponement! This was when I was in HS. YEARS later when I was in college I was warned not to answer my door, because they might try to supeana me again! That would have cost me $100s to appear. It was just the family of the deceased looking for money.

Perhaps a lot of people don't know it, but that's quite normal. If an attorney has not yet been paid, he/she will ask the judge for a postponement. In criminal cases, many times if all the witnesses show up the defense attorney will request a postponement. But if the witnesses against his client fail to show, he'll insist on going ahead with the trial.

As a police officer many years ago, I went to court, as subpoened, many many times. I probably testified in one out of ten times. Almost every time, the defense would either request a postponement, or if all the witnesses showed up, the defense would work out a plea agreement without going to trial.

As a citizen for jury duty, it was a little better percentage. I think I've shown up for jury duty only 6 times and actually served on a jury twice.:D

Bad eyes? Show me a stretch of I95 you can't see a MINIMUM of 1/2 mile in MOST areas.

2500 Feet.

A vehicle at 65 is covering roughly 97 feet a second.

It takes about 26 seconds to go 1/2 mile.

That's no minor distraction.

Not really. I almost had an accident on I95 early in October down in SC. We were moving along in the right hand lane doing 70 or so. There was very little traffic. A car was on the road quite a ways in front of us and that was it. There was a distraction in our car. I do not remember what it was but I took my eyes off the road for a second or two. Looked back forward and there is a car doing 40ish mph in the fast lane. I was able to just barely able to move over before hitting the idiot.

A tractor running on the median would not have been going 40ish mph. The truck driver SHOULD have seen the yellow lights from the safety truck but if another semi had been in front of him his vision could easily have been blocked.

I have not seen anymore information posted locally about the accident.

My guess is there was another vehicle involved that didn't get hit and continued rather than stop. I can't count the number of times I've seen cars dart in front of trucks when merging into one lane only to slam on the brakes to avoid hitting the car in front of the truck. The police said they don't suspect drugs or alcohol. Anyway I think there's more to the story than what was written.

I drive truck, and I can't count how many times the mowers have darted across the highway directly in front of me.

Last year i was heading to a holiday destination in Belgium, driving a stretch of highway with a very steep grade. I had my TDI on cruise control doing 140 km/h downhill and then up one of the steepest highway grades in Europe. I did hear the turbo building pressure when i went from downhill to uphill but didnt pay attention to it. I was politely going back to the right hand lane, to let other cars overtake me if they pleased. I looked around at the scenery, looked in front of me and barely missed a 1.2 liter Fiat Panda with a caravan behind it, howling its little engine up to 5000 rpm in 1st gear up this hill...
With allmost a 100 km/h speed difference there is no time to brake, just peek over your sholder and yank the steering wheel to the left ;)
I bet i could haul his little caravan up this hill about as fast as he could with just an empty Panda :D

Anyways, next time i drive in the mountains i know i'll be safer staying in the fast lane ;)
