I don't believe anyone here has condemned the OP.. just offered speculation as to what could be real world liability based on what is seen in the news every day. Every day that i drive to work I pass bill boards for a law firm with peoples pictures on it saying 'so and so law firm' got me MONEY!
Pretty much lets you know that lawyers are looking for settlements.. The Company i work for is located at an intersection.. there was a car accident involving a semi truck and a teen driver who had a license for one day. teen ran a stop, semi plowed car.. teen died, and another teen in the vehicle critically injured and suffered a serious brain injury. The lawyer sued the truck driver, truck company owner, owner of the leased trailer, owner of the cargo in the trailer, our company because we were at the intersection where the accident occured, our company's president ( as a seperate entity from the company ), the county, his own insurance, and the utility contractor that had installed the traffic signals at the intersection.
After a bunch of depo's and pre trial stuff, the judge dismissed from the lawsuit the portion suing our company's president seperately, and let all the rest of the 'defendants' stand with the lawsuit.
All the insurance co's met and agreed on a 10k$ each defendant settlement, because each defendants legal counsel felt it was cheaper to offer that group settlement ( 80K$ +/- ) rather than risk a trial with a huge damages amount and then start getting assigned % liability. doesn't take much % liability on a 1 mil claim to exceede 10K$.
So there our company is. our ins had to pay out 10K$ just because our office is LOCATED at the intersection where the accident happened. same with each of the other defendants. I'm sure target that owned all the tv's in the cargo trailer was wondering why they were liable for a teen pulling out in front of the semi..
just goes to show you. you can be at fault.. then sue the pants off a huge amount of people.. and it's cheaper for the defendants to settle than defend.
