Zero lot line homes are becoming more common these days. Commercial buildings in older sections of towns often had mere inches between them or sometimes a foot or two was a lot of room. Party Wall Agreements were the answer to commercial buildings which were built on the lot line and shared a wall.

Ultra is probably in the best position to negotiate but the longer he waits the more difficult it may be. However, doing anything hastily in situations like this is also perilous. Legal advice is needed.

The side walls closest the property line are built 9" inside the line so the 9" eve overhang is on the line... the fence is 9" away from my garage wall for all 32 feet... Makes it impossible to paint or clean out leaves from the Large Oak on neighbors side...

Couple of issues:
- sounds like he built an illegally tall fence on the appropriate property line.
- regardless of height, I don't see how you could possibly clean gutters if there is a 7 ft or even 6 ft fence only nine inches away from the structure, at the edge of the eave??

Regarding negotiation, you are in the best possible position, because:
- it is owned by someone who you will not be long term neighbors with;
- they are in obvious code violations on the fence that abuts your property;
- you know they did unpermitted work; and,
- if that work is not disclosed in the MLS listing for the property the real estate agent could also be in harm's way.

I don't know what you want to achieve, but you have much leverage if you use it now. If it were me, I would meet with the flipper, discuss the fence, and perhaps ask in curiousity how much permit fees are costing now for the remodel. After all, you might consider doing the same, eh?

Again, I don't know what you want to achieve. But it seems your time of maximum leverage is now.

Case could be made it started on the neighboring property... but has grown over the years.

It really is on the line... and starting to come up against the foundation concrete...
Drive in a half dozen copper roofing nails, clip the heads off and countersink them...
On a more serious note, I would look at installing wire mesh between the eaves of the garage and the fence, then either mesh or matching boards between the garage wall and the fence to keep the leaves out of the space between the garage and the fence.

I would also stop by code enforcement to "check if a permit was issued" for that work, then send the realtor a certified letter advising them of what you found so that they cannot say that they didn't know of it.

A case could also be made that since the OP got prices and wanted to take it down, but the Flipper flipped out, the liability could have been flipped to the flippin' Flipper.

But we're talking about the fence primarily, aren't we?

My brother in law did that on a tree on the property line at his house. It killed his side of the tree only, and dropped branches all over his parked cars and garage! :laughing: It took many years to kill the entire tree, and by that time, the neighbor that didn't want to go halvsies on the tree removal had moved and the house was left abandoned. :rolleyes:

If the tree is starting to heave the floor of the garage you will probably need to repair it. While that section of floor is removed in preparation for repouring the roots will be exposed for trimming. Paint the cut ends with some good herbicide to prevent them from regrowing....

Paint the cut ends of the roots with undiluted Roundup (Glyphosate). It will then kill the whole tree. Then most likely you will have little problem convincing the "powers to be" that the whole tree should be cut down, being it had died. ;)

I worked for a R/W maintenance company years ago. The power line rep was having problems with a woman who didn't want them to trim the tree on her property. My supervisor gave him some herbicide tablets to go sprinkle under the tree some rainy night. I always thought that was a sleazebag maneuver; if not illegal, at least rather unethical. If they can't do it legally they shouldn't be doing anything. That's one reason why I left the business, and have a rather cynical outlook toward power companies today.

The Flipper through his Broker said I should buy the property and then do with it whatever I wanted...

In 1990 I was in contract to buy the very same home for 130k... everything was in place and the couple filed for divorce... the wife eventually was committed to a psyche facility... it was such a bad situation I just cut my losses and bowed out... shortly after I had moved out of my home and started renting it out.

The husband became a hermit... people asked if anyone lived there... it looked abandoned... I guess the ordeal was too much for him... anyway, I was no longer living there.

2018 I see a parade of 30 yard dumpsters at the property... the home had been sold for 400k cash to a Flipper...

The crews did not speak a word of English or if they did... they did not respond.

When I tracked down the owner he said he would make me a good deal... but knowing none of what they did was permitted it was not anything I would be interested in... don't understand why the Broker Owner would put his license in jeopardy with unpermitted work… but not my problem.

Also... the owner had no choice to replace the existing fence on my side... they had destroyed it totally and I made a point of it...

So the extension of the fence alongside my garage could be out of spite??? You want a fence... I will give you fence type of thing.

I don't live there and my tenants are very happy there... I do use the garage to store classic cars... that is why I kept the property because it had good storage separate from the house...

My survey shows pin location and my garage in location to property line.

New Owner was mandated to replace the Sewer Lateral and in the process the contractor removed all of my landscaping... and dug up my irrigation...

My tenants likes the Camelia and Rhododendrons gone as frees up more space on the side of the driveway... again I have not lived there for many years.

Right now I am just mulling over my options...

Of course should the tree up and die I would by more than pleased... these types of Oaks go not do well in heavily irrigated lawn type settings... they simply don't...
