I'm hallway between KC and Des Moines. I use I-35 a couple times a week. If I get on I-35 and head toward either city the closer I get the stupider the drivers are. Once you are within 30 miles of either city the "move to the right" courtesy disappears. By the time I get in and out of the city I totally understand "road rage". City drivers are idiots. Some of which have been discussed in this thread......

I had missed that section C expanded the definition for 9-21, you would appear to be correct.
Regarding section IC 9-21-5-7, it says that the slow vehicle "shall give right-of-way to the other vehicles by pulling off to the right of the right lane at the earliest reasonable opportunity and allowing the blocked vehicles to pass"
If one had a creative lawyer (and cooperative terrain) it could be argued that wasn't a place where you one could safely pull off to the right due to the width of your load, oncoming traffic, a shoulder that was too narrow, the dropoff from the paved shoulder to the gravel and/or a curve that obstructed the view of oncoming traffic making it dangerous (and as such, not reasonable) to pull off to the right.

Yep, I agree. Wouldn't even take a lawyer in those situations, much less a creative one.:)

It's also just recently become law in Indiana that on a highway with more than one lane in a direction, slower cars have to move out of the left lane and let faster traffic pass, and here's the kicker, no matter how fast they are going! So if the speed limit is 55 and you're in the left lane going 65 and some guy comes up behind you going 66, you have to, by law, pull to the right and let him pass at the first safe opportunity. Only exceptions are, as I recall, if you're going to be turning left soon, or inclimate weather. I love this law. Where's the heart shaped emoji? Cloud 9 will do.

Same thing in Virginia, now. But in both Indiana and Virginia (and I bet in most other jurisdictions as well), it is illegal to exceed the posted speed limit even when passing! So consider the irony. If you're driving the speed limit in the left lane and another driver comes up behind you going faster, you are breaking the law if you don't move over so he can continue to break the law. :confused2:

Hmm - so many differing laws - adds to the confusion. Here in WA you can only use the left lane, on a 4-lane highway, for passing. An awful lot of folks get stopped for just driving on & on & on in the left lane.

Good friend of mine recently totaled a vehicle. He was driving wayyyyyyy under the speed limit on an Interstate Hiway at night. Truck hit him in the rear end. Friend isn't talking. Hiway Patrol determined the truck was in the wrong. Truck driver says my friend was in the left lane. When the truck attempted to go by him using the right lane he swerved to the right into the path of the truck. I believe the trucker.......

I guess I'm just used to coming up on farm equipment going slow on narrow highways. I'll agree lots of folks don't give them the room they need, or, for that matter, the rules they are allowed under our state laws. However, I think they're supposed to pull over first chance they get when they have more than three vehicles backed up behind them, and in mint season, they just won't pull over for anyone. And that makes the car guy angry, and brings out the worst in aggressive behavior.

I attended a tractor safety course here in Texas and they showed a number of accidents and described what happened. Some were because the tractor pulled over to let traffic go by. They pointed out that (here anyway) there is no requirement to pull over, AND you do not know the condition of the shoulder should you do so. There were several roll over accidents of $100k+ machines because the shoulder was soft and would not support the weight.

Yep. But they make it clear that its not your (or my) place to play traffic cop and impede the flow of traffic. We have no idea why the person behind us is speeding, it may be an emergency, so pull over. Indiana State Police have encouraged everyone to move over and let the speeder by, then report them.... so they're kinda encouraging folks to use their cell phone while driving. :laughing:
