Is the OP consulting or asking the neighbor first before he alters his ditches, removes trees, and moves 20-30 yards of material?

Unless he consults the neighbor first, how does doing that differ from what was originally complained about?

That’s the same post I was about to make. I held back and didn’t call her out earlier but I also agree with you with the trout stream part. I wouldn’t consult with my neighbors about a project on my property either. All the runoff on my property ends up at approximately the same place. Digging a few ditches on my property makes no difference to them. Kinda like driving in a straight line from point A to point B or driving in a zigzag pattern.

So a neighbor, who you don't know, or have approached to civilly discuss the issue, is doing something legal on his own land that doesn't effect you - in your own words and the county inspectors,

How's he supposed to know it's legal until he asks the proper authorities?


and doing something that sounds very similar to what you want to do.

And you're running around trying to get him into legal trouble, but you just can't find anyone to take your case.

Can't find anywhere that he said he wants to get the neighbor in legal trouble


..but you're holding out, pressing on, siccing inspectors on him, just itching to find something to get him in trouble with.

And he told you this when?


Your last hope: "Wetlands!" It's just got to be "a violation of some federal wetlands act or the other."

Thanks, I thought I might of missed something so I went and reread every post from the OP. Yep, I missed that there is some concern about debris, though we don't know the extent of what this debris might be or have any pictures.
What else?

You generously give a lot of good advice here. Thank you on behalf of all.

But moving down the darkened path of deception is behavior below the fine upstanding person you are. Please reconsider.

I thought someone mentioned a trout stream..... :confused: Sorry, it's sometimes hard to read on my darkened path of deception. :)

My mistake and apologies. The original claimant for the deceptive move has stepped forward to claim credit. I somehow missed that along this long journey. But I was sincere to thank you for the quantify of great advice you provide.

Just one question regarding the thread titled "Neighbors behaving badly." What bad behavior have they done?

I was taught to bring issues directly to the other person. Solve them without expanding if that is not needed.

These days, that can get you shot.

Advice here includes making anonymous calls and incident reports, engage in deception, etc.

Well, since he talked to the Inspector in person .....

Title of thread is because at the time I posted the original I did not know if what the neighbor was doing was in fact legal or not. Hence the call to the drainage board to find out. As bonus information I got the fact that the additional water the neighbor is going to add to the ditch will not affect me in the slightest. I also got bonus information that what I want to do to my own ditch will not affect anyone down stream of me.

Can't edit the title of the thread so no joy there.

I don't really get the "hate" for calling the drainage board to ask the question. Their web site specifically states their permission is required for any outlet into the ditch. However the inspector advised they do not regulate surface water going into the ditch. Any tile going into the ditch under 12 inches in diameter is also not regulated so long as it is not discharging water from your roof or the like (or I am sure septic system).

So no need to discuss with the neighbor. He is doing what he wants on his land and it is not affecting me, and according to the "experts" I talked to, will not. So nothing to see here.
