I understand on the attorney comment. I have used two, both coming from referrals by friends. They are both O&G lawyers. The first one said I'm screwed so I went after another one. He's a tad more opptimistic but still reserving his cards. I wouldn't dare consider running this deal by myself. I'm just smart enough to know when I'm over my head. I do like the idea of being the one who broke down the big oil company but it just isn't going to happen. I'm just a Texas redneck trying to make sure I don't get taken anymore than the next guy.

Its true that if the landman shows up at my door, then I do have some room to negotiate. His first trip to my house, he had the "damage release" all printed out, dated and ready for me to sign. I said no way. This release would take away all my rights to any future damage claims. Horribly one sided. He said I'll go out to the truck and print the check and bring in a W4 for our tax records. I said don't bother. I think at that point he released I wasn't going to roll over and he backed off a bit.

I'm basically asking them to build me a 4 acre tank (their left over frac pond), set two culverts in some low water crossings I have and then to move my deer blind since it's on their pad site. I think I'm being very fair. I've heard tales of them putting in 1.5 miles of nice road through out a ranch or building nice pipe working pens for someone. I do hate the fact that they can use all the groundwater they want to get at the minerals. Just seems crazy since our water is so scarce these days. They are offering some small amount for the acre's on the pad site and then 350 acre for putting back the grass. I told them it isn't about the money. I'd rather have services done, i.e. clearing, ponds, etc. I figure a 4 acre, 20ft deep pond is worth north of $150k. If they leave me a pond like that, I'm a happy camper. I may be able to sell them some clay to build their pad site, but that won't be much money.

Ask for free gas if it is available.
I didn't see anybody point out, but lots of times if the well doesn't produce they will use it for an injection well. You really don't want that. All the brine and fracing fluids have to go someplace so the drillers maintain a few injection points to put it all back down in the earth. These places will have large trucks coming about any time of the day. See if there is any way you can limit the used of the well for this purpose.

Also, be aware that injection of fracking chemicals can contaminate the water table for you and your neighbors forever. Here in NB fracking has been banned for the whole province, becoz of water table issues. The issues in Pennsylvania are warning enough.

Now the O&G companies are trying to blackmail our NB provincial gov't to try to force the gov't to relent on the fracking ban, by cancelling a planned gas pipeline across our province. Strong arm tactics!

Chances are that in Tx that if you (or your family) don't own the mineral rights you will never get them. Most of the ones that were up for grabs were bought up by large corporations long ago for beans. Once they have them they will never sell because they have no reason to unless they are selling them to somebody who intends to produce O/G.

Just remember that the drilling company's biggest concern is you. If you are not happy you can make their life miserable and expensive in the long run. They may have the rights but if they are not a good neighbor - that can go both ways. They are not out there 24/7 and they do not want the hassle of ticked off neighbor. Sometimes a little acting goes a long way. Remember you have to sell this to the contract landman who has to go back and sell it to the office so you need to get him to believing that helping you is in their best interest.

How do you figure they are " strong arm tactics" ? Why would they invest in a pipeline if they aren't allowed to drill? You want them to drill elsewhere and then bring you the cheap gas?
I have my land leased and really hope they drill someday.

If they drill on your land, I bet your perspective of cheap gas reverses. You will want the price of crude to go back up to $100 a barrel?

I dont have mineral rights so I won't get a penny from the production. Nonethless I do like cheap diesel fuel.
