# of gallons of diesel before needing hazmat? ( 120? )

I'm digging thru FDOT specs and notes here, and think I remember the anser / cutoff being 119/120g container before needing hazmat. IE you can carry LOTS of 5g containers.. but if a bulk container, it tops at that magic cutoff of 119/120g. And IIRC, even if you have a 250g tank, filled to only 119g, it's still not legal without hazmat, as the tank capacity could exceed 119.. etc. Am I correct here? I need to set some fuel out on a small job and a 115g HHO tank is available to use to haul it.. or I can 55g can it out there if needed. thanks

That's the way I remember it also.

That's how it is here also. Used to see a lot of 110 & 115 gallon tanks. Now they are all 100 seems like.

1993 will cover diesel fuel or oils. As they are combustable. A 1203 is needed to cover gasoline as its flammable. Yes they are both class 3 placards for flammables but it has to do with the flash point of each. http://www.phmsa.dot.gov/pv_obj_cac...61048C11277A9DE7443DB0000/filename/130180.pdf

Edit. I must have looked at something wrong on the 1202. It's for fuel oil also.

You can't haul a empty tank over 119 gal., if it held fuel previously you have to have hazmat. If the tank is cleaned and purged you can haul it without.
My friend just went thru this in FL., last week.

And many jurisdictions play with the regs and how they will enforce them differently. I often pull into a local gas station and fill an old 30 gallon oil drum with gasoline that we use for our JD zero turn mower and some portable generator use. Nothing placarded. No one gives a rip. Sure, it is technically a no no, but the local gestapo figures that there are other things that they can be doing than scouting out gas stations for rural folks coming in and filling "unapproved" containers. In other jurisdictions, some LEO would probably try to make the case that doing this is a terrorist act of some kind.

I do the same thing with diesel, but I use a 55 drum or two.

Federal RQ is 42 gallons on land or a sheen on a waterway. For the state of LA the RQ is 100 pounds.

In Texas, or at least what I read, was on weight and that was 1000# or above for the requirement to placard. I carry 3ea 55 gallon steel drums in a dedicated trailer to the fillerup and keep the fuel weight under 1000#. Never had a problem.

I can tell you from experience that if anyone has a fuel spill on the road or at the fuel station, the right thing to do is call 911. When that happens, dispatch will let the local FD know as well as the parish/county OEP know. OEP usually will be the one that makes the correct notifications. We get called all the time to HAZMAT incidents of this type at the local stop and rob.

Oh and as a piece of advice, if you ever knock a drum over and it gets punctured or the bung pops off, be sure to quickly roll it onto its side so that the hole is above the level of the liquid inside. This stops the leak until someone shows up with plugging and patching material.

Out on CR42, in eastern Marion County, couple OTR drivers would pull off on a kinda vacant lot. Owner told them he wanted something like $100/week for each truck to park. Later, the fuel tanks got mysteriously drilled, spilling hundreds of gallons. Truckers insurance had to pay for remediation. I assume police reports where involved, but no one ever proved who drilled the tanks, and the drivers found another place to park.

How do I know, I was the county road inspector on a repaving project past the area, and asked what was with the back hoe and trucks hauling off soil from the lot for no reason.

Travelled that road many times myself. Used to go out 42 weekly as my fil lived in Daytona, and mil in Ormond. Mil still lives their for e few months, but is moving to assisted living in mt Dora soon.

And yeah, they dug the dirt up from the spill area and hauled it off somewhere. Not sure what the guys insurance paid when he hit us, but I bet they weren't happy fixing that Mack with an oxbody, and the dirt berm/swale, and that guys much much shorter car :)
