Well he wanted to pay with CC over the phone but i told him no that it had to be a cash deal and that i had to be paid before delievery. I hated to do it that way but figured it was for the best so my delievery guy wasnt put in the middle of things on having to clolect. He seemed to be ok with it. We will see.

I am a little offended by your first statement. Saying such a thing does not, IMHO garner you any credibility in trying to prove your point.

Second, CONTEXT is very important when reading the lengthy agreements as you have briefly quoted. You present only a couple of sentences within the entire document that proves YOUR point- (since most of us are not familiar with the entire document) is OUT OF CONTEXT.

I appreciate you being able to direct us to relevant documents regarding this but, asserting yourself in an attempt to shut down further discussion is not productive.

As for hijacking the thread, (which you also have done)- I would leave that to the OP to comment on.

This is direct from the MasterCard company rules:

"A Merchant must honor all valid Cards without discrimination when properly presented for payment."

This is what Visa's rules say:
"If the customer indicates that he or she wants to pay with a Visa card, the merchant must make sure that choice is honored."

"In other words, the choice is ultimately the customer's."

"However, if a customer chooses Visa, it must be processed as a Visa transaction."

Folk's it's not even debatable what the words mean. "All" means all, and "the merchant must make sure that choice is honored" means what it obviously means.

It is not the customer ... the merchant has the choice ... don't like it go somewhere else.

I think everyone needs to step back and take a deep breath before someone ends up banned and the thread closed. Personally, I'm looking forward to hearing how this one ends. I expect jlsmith will resolve it with the professionalism he has displayed throughout this ordeal.
