I didn't read the document, but without even looking at it I'd say that its just stating that the pump has to meet certain emissions standards. Which isn't a warranty against it breaking down. Just says it has to be certified to meet the emission standards for 3000 hours or five years. I think your reading more into it than what it was intended. Of course I've been wrong a couple of million times before.

make that a million plus one ;) ...please read the document...it says it must be repaired too.... :)

the label shall read:

`This nonroad engine is warranted for five years or 3000 hours of operation from the date of release to the owner, whichever first occurs.''

warranty = repair, not simply a spec that must be met...

This is not just a guide, it is a warranty I had to use it on a 3 Year old New Holland Tractor with over 300 hours. It was outside the Manufactures warranty period. The language should be in the Owners Manual as was mine or some other document that comes with the Tractor.

I had to go to battle with the dealer on this also.. NH Corparate confirmed and covered it Saved my like $1700.00

Yes, you're correct of course...it's something like a $37,500 fine PER engine if they don't include it...I checked my manual but it's not there...

I truely hope it is covered as you say. No injector pump should fail with only 300 hours on it.

Okay, read the whole document. I still say that the only thing it is saying is that the importer and the origninal manufacturer has to warranty that the engine meets the required EPA emissions requirements. NOT warranty it for mechanical repair. Yes, it does say that said engine has to be repaired to MEET THE CERTIFICATION. If the engine does not meet the required EPA emissions requirement then the importer is responsible for getting the required certification and WARRANT that required certification. Guys its the EPA they don't care if your pump fails or not, they just care that it meets their required EPA emmision standards and is certified that it does.

Again, I hope you get it fixed at no cost to you.
I'll have to show my attorney friend this document as he owns several rolloff trucks for a paper recycling bussiness and a bunch of heavy equipment. I'm sure he would be interested in getting his injector pumps fix for nothing.

I also read my Deere Manual and it is somewhat confussing................at least to me????? It does say the injector pump is to be free of defects and waranted as such. I'll let my friend read it and see what his take is.

Have your Attorney friend obtain a copy of EPA, 40 CFR 89 subpart A. This articles states new non-road engines subject to the provisions of this article, 40CFR 89 subpart A must be designed, built and equipped at the time of sale to meet the US EPA regulations for non-road engines.

Items covered:

1. Fuel Injection Pump 2. Nozzle Assembly
3. Injection Pipe 4. Connector of Fuel Line
5. Fuel Pipe Assembly 6. Inlet Manifold
7. Inlet Pipe 8. Inlet Pipe Band

Yea, I read that in my Deere Manual. Same provisions. Let us know if your dealer takes care of it under warranty. As I stated before, I hope they do. Maybe injector pumps are covered under the EPA document. Injector pump failures are fairly uncommon and maybe the manufactures figured they wouldn't be out much by covering the pump for 3000 hours or 5 years. That would be a good thing as the pumps are quite expensive to replace or repair.
