Post Hole Digger lawsuit ends poorly for farmer

This is why I am scared to death about letting inexperienced people use equipment. It doesn't take long to teach someone to drive a tractor, especially a licensed driver. And everything seems fine. It's what happens when things go wrong that worries me. I've seen some peoples inappropriate reactions or none at all.

I'm always watching and correcting incorrect machine use, but find some people are offended because they "THINK" they have mastered the thing already!

In grade school,I remember how horrified I was when they handed out those Mutual Of Abomaha (Or Something Like that) insurance applications. They would spell out how much money you would get for the loss of an eye, hand or a finger. I remember thinking it was peanuts! When did body parts become so expensive?

Dig into the mcdonalds case. It's really fascinating. The amount was super high because the jury felt mcdonalds was being a bully. The mcd attorney was arrogant and mcds was at fault.

I have no idea about the defendant in this case but I put it up for two reasons. One .... Ouch... Ouch.... The second is that as a small farmer or business owner you are obligated to safety train your crew just like the big boys..... Inconvenient for sure. But necessary to avoid this outcome.

if someone is at fault, then sure, there needs to be compensation. i don't see any problem with that. my issue is 4 million dollars. i assume the lawyer will take a massive chunk - personal injury claims seem to be more about winning the lottery than compensating for injury or loss. what would the injured person's projected lifetime earning potential have been? i'm betting 4 million or less. unless the story is not being fully told, how does that amount relate to an injury that takes you out of the workforce for only a period of time. certainly i can see covering all medical costs, any lost wages, other miscellaneous costs involved, and a reasonable extra amount for suffering. also, add in a fine for the employer if he was negligent. i just can't see 4 million. justice is supposed to be blind. it should be based on the facts. arrogant lawyers and "teaching a lesson" shouldn't have any bearing on the issue. when they do, the system isn't working.

I wonder if the guy really lost more than a patch of skin and they kept that part out of the news. Maybe he lost one and is now a swinging single. Maybe he lost both, thus the $4M.

I local guy lost his whole arm from one . He was by his self and its amazing he lived .

Sent from my iPhone 5 using TractorByNet

Recently the guy was on the tractor and wife on the ground. I do not know how it happen but the auger caught her coat and jerked off both arms before the guy could stop the PTO and he said she was dead by the time he got off the tractor.

My post hole digger is very slow and wears my arms out but short of laying it down and tipping over it the danger is small. I have never used a powered hole digger and did not understand dangerous they could be.

Any powered equipment that we use to help make the job easier on us, also has the potential to hurt or kill us. That's the risk we take when we choose to use this type equipment. I'll take the risk and just be as careful as I can be. In my opinion,,The main thing is, to have no distractions when using this equipment. 1 slip up is all it takes

I like money but I don't know if I like it that much. And I sure don't want to be able to qualify to sing tenor.

My advice to all operators of pto powered machinery is to never leave the tractor seat while the tractor is running or the pto is turning. This seems to be common sense to me? Ken Sweet
